Michael Lauber defends tooth and nail

In his appeal to the Federal Administrative Court (TAF) at the end of April, the federal prosecutor Michael Lauber accuses the Supervisory Authority of the Federal Prosecutor’s Office of bias. He denounces a ‘slanderous vendetta’.

“The fundamental principles of the rule of law are thrown overboard,” says Michael Lauber, according to extracts from the appeal cited by Tamedia newspapers who obtained the 70-page document.

The members of the Supervisory Authority of the Public Prosecutor’s Office of the Confederation (AS-MPC) were ‘biased’ and had ‘a bias against him’, reproached Mr. Lauber. The latter was the subject of a disciplinary investigation mainly due to secret meetings with FIFA President Gianni Infantino.

In its report, the AS-MPC concluded in March that the Attorney General committed very serious breaches before, but also during the disciplinary procedure. She ordered that the prosecutor’s salary be reduced by 8% for one year. It was against this decision that Michael Lauber appealed to the TAF.

The reproaches of the AS-MPC are full of speculation, speculation and a constant disregard of all the real facts and extenuating circumstances, accuses Michael Lauber, according to an extract quoted by the newspapers. He therefore requests that the sanctions claimed against him be lifted.

Judges and parties

Another criticism concerns the widening of the scope of the disciplinary investigation to include the actions of the prosecutor during the investigation. By acting in this way, the members of the AS-MPC became judges and parties and were therefore ‘no longer impartial’, argue Mr. Lauber’s lawyers.

The Federal Administrative Court is expected to rule on Mr. Lauber’s appeal in the coming months. Michael Lauber will be heard on Wednesday by the Judicial Committee of the Parliament. His hearing will be decisive for the launching or not of a revocation procedure against him.

National Councilor Lorenz Hess (PBD / BE) has applied for dismissal from the commission, but the pressure does not stop there. At the beginning of May, the parliamentary groups of the PS and the center (PDC / PEV / PBD) invited the public prosecutor to resign on his own.
