The court was reluctant to use her statement as evidence and said it “cannot determine with certainty that there was a conflict between the two.” Nor, according to the judges, had it been proven that “deliberate and targeted shooting” by E. He was therefore acquitted of attempted manslaughter.

However, E. was convicted of illegal possession of weapons during probation because of a previous conviction and taking “unacceptable risks.” “He grabbed a loaded weapon and aimed it at the victim without checking to see if it was loaded. He has caused indescribable suffering.”

The judges further called it “staggering” that after the accident, E. left the bleeding victim for dead and drove her car for two hours. Only then did he return to the house and call 112. “He has only been concerned with the possible consequences for himself and has not cared about the victim.”

The Middelburger attributes his actions to “panic” after the incident.

In addition to the 2.5-year prison sentence, E. must pay the victim and her mother 272,000 euros in damages.
