One hundred and thirty-three witnesses for a trial of the judiciary, its currents, maneuvers, partitions, agreements under the bench that have governed the subdivision of the judicial offices throughout Italy for ten years. Yesterday Luca Palamara, former president of the National Magistrates Association, investigated for corruption, deposited the list of witnesses who asked the disciplinary section of the Superior Council of the judiciary to interrogate him in the proceedings against him. Palamara knows he is risking the expulsion, he knows that his toga is hanging on a thread. And he decides to sell the leather dearly. The list he filed yesterday is potentially devastating: for the characters called to testify, and for the topics covered. Some explicitly, some between the lines, but equally understandable. Including the test chapter on which Palamara asks that Ernesto Lupo, former first president of the Court of Cassation, number 80 of the list answer: “On the autonomy of the decision-making choice of the commission for executive positions and the plenum of the CSM”, we read, “and in particular on those carried out in the 2014-2018 council ». The promotions to higher positions of some of the magistrates who in those years had contributed to the sentencing sentences of Silvio Berlusconi end in this way. The proof of what Palamara has said several times in recent days on the need to understand well how the trials went to the Knight.

Incredibly, seven days after the hearing against Palamara it is not yet known who will make up the disciplinary section of the CSM: as if it were difficult among the members of the Superior Council to find someone willing to face the explosive material submitted by the accused. Starting from the first choice, the most delicate: which and how many witnesses to admit out of the 133 on the list. That is: how much to allow Palamara to widen the battlefield.

The list includes politicians, men from institutions, magistrates. Among the latter, almost the entire leadership of the currents that governed the CSM: from Edmondo Bruti Liberati to Claudio Castelli to Piercamillo Davigo to Antonangelo Racanelli, all called to tell how relations with political parties really worked, starting from the appointment of the vice president of the CSM. There are two former justice ministers (Flick, Orlando). And there are famous or unknown magistrates, all called to answer the same crucial question: “the existence or otherwise of a constant practice, by magistrates aspiring to executive positions, to confer directly or through an intermediary person with the members in charge of the CSM “. It is the practice of the recommendation, of the consortiums. And the appearance of some names on the list makes it clear that Palamara is ready to reproach him for having knocked on his door for a long time.

There is, just as deadly, the list of texts that according to Palamara must explain how Perugia’s investigation into it really was born, starting from the battle for the leadership of the Prosecutor of Rome. There are officers and non-commissioned officers of the Gico della Finanza, called to tell why the trojan was installed, and why it went intermittently. There are cases in which it worked even in spite of the orders of the prosecutors, such as when he records the meeting between Palamara and the deputy Cosimo Ferri, covered by immunity. Other times it turns off inexplicably. Starting from the mysterious interruption on the evening of 21 May 2019, when the dialogue between Palamara and the then pg of the Cassation Riccardo Fuzio disappears from the radars at 21.53: it is the chat in which, according to rumors that have been circulating for some time, the role is explicitly evoked of the President of the Republic. The inclusion in the list of Stefano Erbani, legal adviser of Sergio Mattarella, a man connecting the Colle and the CSM, also says that the Quirinale cannot be left out of the story.

At the center of everything, the casus belli that marks the beginning of its end, for Palamara remains the game for the Prosecutor of Rome. And here everyone draws in, from the old boss Giuseppe Pignatone who would also have participated in the meetings with Renziano Luca Lotti, to the deputy prosecutor Paolo Ielo, at whose house in September 2014 they would have gathered in addition to Pignatone and Palamaara, three other big of the ANM “on the subject of the organization of the Rome Public Prosecutor, also with reference to future appointments of deputy prosecutors”. It is the dinner where, according to Palamara, after the election of the new CSM, the center and left currents (Unicost and Area) share the Capitoline Prosecutor’s Office.

And it worked like this, from the mists of time: he asked that even the octogenarian Cesare Mirabelli, who was in CSM between 1986 and 1990, over thirty years ago, be interrogated by the CSM. Magistrates from all over Italy knew this and queued for our help when they aspired to a power of attorney, a court, an appeal court. An open-air market to which they belonged, writes Palamara, «secretaries, local representatives and representatives of the associative groups; togated and ex-togated components; lay members and their direct contacts in the world of politics; aspiring to the positions assigned by the CSM ». If they let him do it, it will be a fun process.
