Love | Education. Parents lose their fight against the school card

These parents are bound to be disappointed. After more than a year of mobilization, the request of Muriel Henry-Noël and Eric Noël-Machecourt has just been rejected by the administrative court of Besançon. This family requested the cancellation of a deliberation voted on December 2, 2019 by the departmental council of Jura.

This deliberation changed the school map, meaning that children domiciled in Augea, Cuisia, Cousance, Digna, Gizia, Rosay and Chevreaux would depend on the recruitment sector of the college of Saint-Amour. Until then, these families could educate their children in Cuiseaux (located in Saône-et-Loire but closer geographically) or in Saint-Amour (in the Jura, but further away). In fact, a large majority opted for Cuiseaux.

Additional travel time

The Department explained this choice by the fact of wanting to swell the ranks of the college of Saint-Amour where major renovation work is taking place. An incomprehensible choice for parents, who felt that this decision would lead to an increase in travel time for their children. A petition had collected more than 1,600 signatures.

“We must be united”

“What disappointed me was that parents could bring this case to justice,” says Clément Pernot, president of the departmental council. If we want the Saint-Amour college to be sustainable, we must rely on as many people as possible. We must be united “” We are not against a renovation of the college, but for us, the Jura solidarity would have consisted in maintaining the college of Saint-Amour there are already twenty years “, answers Muriel Henry-Noël.

Clément Pernot understands despite everything that “parents can assert rights insofar as they have been disturbed in their comfort. We will respect the exemptions for siblings “” It is not a question of comfort, but of the future of our children for whom we wanted to avoid wasting 10 hours per month in the journeys “, reacts Muriel Henry-Noël.

“The notion of proximity is not brought to the fore”

The family will not appeal the decision. “The procedural irregularities were deemed too weak to annul the deliberation of the departmental council. The notion of proximity is not brought to the fore in the law, which is regrettable with regard to sustainable development, ”said Muriel Henry-Noël. Except in the case of siblings, only children domiciled in the recruitment sector of Cuiseaux will therefore be able to attend this college.
