Lindlar: sentenced to a fine for two per thousand

Without shoes, but with almost two per thousand alcohol in his blood, police officers found a 36-year-old from Lindlar at the wheel of his car. The luxury vehicle was parked in front of the man’s driveway with the engine running and probably had a recent damage to the rear – the ignition key, however, could not be found.

The Wipperfürth criminal court now tried to shed light on what happened on the night of June 2020. The defendant was silent on the allegations of the public prosecutor’s office. She was convinced that the man had driven drunk. Because the police did not discover the key either in the car or in the immediate vicinity, the man started his car, which was equipped with the so-called keyless go system (see article below), and drove home from there, the prosecution concluded.

On the night in question, the two police officers reported on the witness stand that he had also admitted to having had a drink in the center of Lindlar. The defense emphasized that his statements at the time could not be used. Nobody saw the client drive and, moreover, the criminal offense was not fulfilled. “In the case of a non-rolling vehicle, one cannot speak of the drunk driving mentioned in the law,” said the defense attorney.

The court saw it differently and sentenced the Lindlar resident to a fine of 2,400 euros for negligent drunk driving. From the point of view of the court, it is clear that the accused had come driving to the place where the police officers met him, it said in the verdict. A driver’s license ban of ten months was also imposed, of which the man has already completed six months.
