Moses is in trouble. He would like to open up the sea of ​​administrative difficulties which overwhelm him. But the waves are too high. 33 years old today, this Gabonese national was in a regular situation in France where he works as a designer designer in a company located at the Technopôle of Metz. “He had an employee residence permit,” says his partner Lucrèce. She talks about it imperfectly because the document is no longer valid since February 2020.

Negligence? Not at all. “Two months before the expiration”, Moïse, domiciled in Montigny-lès-Metz, requested the renewal from the prefect of Moselle, whose services are naturally competent to handle the case. Only, all the parts leave the department… for Nancy. How? ‘Or’ What ? Why ? “He did not take his feet to go there”, jokes Lucretia.

Emails, more emails

A little humor and a necessary distance help him to overcome a probable error of orientation which is the cause of a cascade of problems. Moïse discovers it in February, while still waiting for a title that he should already hold in hand. He is not coming. Not even in March or April. So he turns to the Moselle prefecture to find out the position of his file. The receptionists invite him to go through email. “Every month until the summer he sent an email. And each time he got an automatic response that didn’t correspond to the situation ”. Obviously since the file drags in Meurthe-et-Moselle, place Stanislas, which would have yet issued a residence permit. But no one saw him.

Unable to recognize her child

In the meantime, the situation of Moses becomes very worrying and the first consequences are already being felt. On the family level, Lucretia is expecting a daughter in December, but Moïse cannot consider prior recognition of paternity since he cannot prove his identity. He also had to give up the purchase of a car, “for lack of access to credit”, illustrates his lawyer. No papers, no money.

Professionally, his employer asks him to present the document he does not have. “You have to understand it. Because you need papers to hire a foreigner, ”says Lucrèce. His boss, if he wants to avoid sanctions, must fire him. He even should have done it already. The administrative situation leads to a social, family and economic nightmare.

“I am going to write to the prefect to denounce the casual handling of this file, to make a request for compensation in view of the damages my client has suffered. In case of refusal, I will seize the administrative court. Today we must denounce the lack of access to the administration which, in addition, is “bunkerized” ”, indicates Mr.e Amadou Cissé.

Lucretia sticks to one observation: “Moses went from a regular situation to an irregular one because of the administration”.
