The legal services of the Santa Cruz de Tenerife City Council have appreciated indications of administrative prevarication in the granting of the contracts for the assembly of the Carnival stages during the stage of the socialist mayor, Patricia Hernández, by the mayor who held the Party Area , Andrés Martín Casanova.
In the report, to which Radio Club Tenerife has had access, it is established that said hiring meets the four requirements established by the Supreme Court for administrative prevarication: a decision issued by authority in an administrative matter; objectively contrary to the law, that is to say illegal; Absolute lack of competence, in the omission of essential steps of the procedure, that causes a materially unfair result and that the resolution is issued with the purpose of making effective the particular will of the authority or official and with the knowledge of acting against the right .
In this way, the Legal Services endorse the opinion made by the Senior Official issued after the investigation commission ordered by the mayor, José Manuel Bermúdez. As announced by Radio Club Tenerife, this report from the Legal Services has motivated the opening of new investigation procedures by the Santa Cruz de Tenerife Prosecutor’s Office.
