Leave for organ or tissue donation | Workplace health and safety equity standards commission

Workers can be absent from work for up to 26 weeks without pay in a 12-month period for organ or tissue donation for a transplant. During their absence, their employment relationship is protected.

Paid days of absence

After 3 months of uninterrupted service with their employer, the worker could be entitled to 2 paid days of absence to donate organs or tissues for a transplant unless these days were used during the year for the following reasons:

Notice to employer

A worker who must be absent from work for an organ or tissue donation must notify his employer as soon as possible and mention the reason for his absence. In certain circumstances, the employer may request a document justifying his absence.

Back to work

The worker’s usual position and the related benefits are protected for the duration of his or her absence for organ or tissue donation.

When he returns to work, the employer must reinstate the worker in his or her usual position and give them the salary to which they would have been entitled had they remained at work.
