Lawyers and politicians positively value the choice of new TC judges

The election made this Friday night by the Council of the Magistracy of Eunisis Vásquez Acosta, María del Carmen Santana de Cabrera, José Alejandro Vargas Guerrero and Manuel Ulises A. Bonnelly Vega as the new judges members of the Constitutional Court (TC), has been well valued by lawyers and politicians in the country.

The lawyer and politician, member of the Central Committee and Secretary for Legal Affairs of the Dominican Liberation Party (PLD), José Dantés Díaz, wished the selected ones congratulations and the greatest of successes in the delicate functions that they will carry out from the next week.

“We hope that through the defense of the Constitution the Social and Democratic State of Law of our country will be strengthened,” said Dantés Díaz.

For his part, the renowned jurist, Eduardo Jorge Prats said that the four new judges chosen represent a not so liberal cohort of magistrates and criminal lawyers that will decisively influence the work of the Constitutional Court and that will fluctuate between the defense of the penalty and that of the due process.

Likewise, the criminal lawyer Félix Portes highlighted the selection of magistrate José Alejandro Vargas, but in turn, maintained that his appointment left him with mixed feelings. “On the one hand, his choice was more than deserved, because he has merits and a great career, on the other hand, we will miss in Ciudad Nueva (Palace of Justice), his wisdom, sermons, humility and warm greetings,” he recalled.

He recalled that the magistrate came to Ciudad Nueva and greeted everyone: judges, prosecutors, lawyers, users and that he always walked humbly in the hall and sometimes spent minutes talking with anyone who put a topic on him.

The new judges will be sworn in next Tuesday, January 26, at a time that will be informed later.

Eunisis Vásquez Acosta, María del Carmen Santana de Cabrera, José Alejandro Vargas Guerrero and Manuel Ulises A. Bonnelly Vega will replace Wilson Gómez Ramírez, Kathia Miguelina Jiménez, Hermógenes Acosta and Ana Isabel Bonilla, whose term in the High Court expired.

Senator proposes ratifying Milton Ray Guevara

The secretary general of the Social Christian Reform Party (PRSC) and spokesperson for that organization in the Senate of the Republic, Ramón Rogelio Genao, proposed today to the National Council of the Magistracy (CNM) to ratify Dr. Milton Ray Guevara as president of the Constitutional Court ( TC).

He explained that the proposal of the PRSC is that the current president of the TC be ratified in the position until it concludes the 12-year exception period for which he was elected.

The senior reformist leader and senator for La Vega province also demanded that the CNM have two of the four positions they choose from the Constitutional Court be filled by women.

“We also want to reiterate our request that the criteria used by the CNM for the renewal of the Supreme Court of Justice (SCJ) be reviewed,” he said.

Genao argued in that sense, that it is not one judge but five who have the performance evaluation pending in the SCJ, which can be ratified or removed.

He also explained that the magistrates who make up the Superior Electoral Tribunal (TSE) “have expired since August 16, 2020, due to their period being coincident with the presidential and congressional period.”
