Lawyer expelled after running into policeman | Financial

The measure for the Board of Discipline was full after his successive attempted aggravated assault of a police officer, mixing of the records of his law practice and those of his own Shisha lounge, and several previous suspensions for malpractice. The disciplinary judge calls Kaya’s actions “absolutely unlawful, unworthy of a lawyer.”

Shishalounge

Burhan Kaya has been in the news several times in recent years through a conviction for assault and threats, various speeding offenses and a shooting on his shisha lounge. The Eindhoven shisha lounge Lâle (Tulip) was closed after the shooting incident by order of the mayor and the permit was withdrawn, but the bar nevertheless opened again as usual.

Pursuit

Last December, Kaya was detained for six weeks after a wild chase with several police cars through the center of Eindhoven. A few minutes earlier, despite a restraining order, he had been banging on the front door of a friend with whom he had a ‘difficult relationship’ in the middle of the night. In the chase, he drove through red lights at high speed and then came to a stop against a police car. The officer in that car then filed a report for attempted manslaughter.

The lawyer is now being prosecuted for threatening the girlfriend and her mother, assaulting her sister and attempted serious assault of the policeman who was pursuing him.

Baiting

According to the expunged lawyer himself, there is a smear going on against him. The dean would no longer want him as a member of the profession and the police also treat him inadmissible, says Kaya. In addition, he would not have rammed a police car in the aforementioned chase, but the policemen themselves crashed into each other and subsequently rammed the car of the lawyer. When he was arrested, the officers went wild and allegedly assaulted him seriously.

Illegal

The Board of Discipline qualifies Kaya’s “repeated escalations in the private sphere as absolutely unlawful,” thereby damaging trust in the legal profession. And while the combination of operating both a law firm and a shisha lounge is not prohibited, the council calls it “highly undesirable.” But because Kaya also combined the administrations of both companies, there is talk of “a violation of financial integrity.”

In the ruling of last Monday, the disciplinary judge stated that “the seriousness of the accused behavior, Kaya’s persistence in his behavior and his disciplinary past leave no other choice than the measure of cancellation. After all, previous suspensions did not lead to different behavior. ”
