Kominfo Supervises NFT Transactions in Indonesia, Buying and Selling Marketplaces Can Be Blocked All

In response to this trend of NFT being loved, the Ministry of Communication and Information (Kominfo) supervising NFT buying and selling activities in the country. If there are users who violate the terms of the NFT transaction, they will be prosecuted and processed by law.

This was revealed by the Spokesperson for Kominfo Dedy Permadi in a written statement, as compiled KompasTekno from official site Kominfo, Sunday (16/1/2022).

“The Minister of Communications and Informatics has ordered the relevant ranks at the Ministry of Communication and Information to oversee the activities of Non-Fungible Token (NFT) transactions that run in Indonesia,” wrote Dedy.

In supervising the buying and selling of NFTs in Indonesia, Kominfo coordinates with the Commodity Futures Trading Supervisory Agency, Ministry of Trade (CoFTRA) as the authorized institution in the governance of crypto asset trading.

NFT Marketplace is threatened to be blocked

“Both in the form of violations of the provisions on the protection of personal data, to violations of intellectual property rights, continued Dedy.

This is in line with Law Number 11 of 2008 concerning Information and Electronic Transactions and its amendments and implementing regulations.

Dedy explained that the law requires all Electronic System Providers (PSEs) to ensure that their platforms are not used for actions that violate the law.

“Violations of existing obligations can be subject to administrative sanctions, including termination of platform access for users from Indonesia,” said Dedy.

When buying and selling NFT, users do have to make transactions via email marketplace NFT only, like the biggest NFT marketplace OpenSea or other.

Indonesia itself also has marketplace Local places where NFT is traded include Paras.id, Kolektibel, TokoMall, Artsky, and others.

Well, all of the aforementioned NFT buying and selling sites are included in the Private Scope PSE category. This means, if the PSE, which is engaged in the NFT sector, does not comply with its obligations according to the applicable regulations, it can be blocked by Kominfo and eventually cannot be accessed by the Indonesian people.

Dedy also emphasized that legal sanctions will also be applied to users of the NFT trading platform who violate the law.

Unfortunately, in the written statement, he did not specifically explain the legal basis and legal threats that can be imposed on users who violate.

“Kominfo will take firm action by coordinating with CoFTRA, the Police, and other Ministries/Institutions to take legal action for users of the NFT transaction platform who use it to violate the law,” said Dedy.

Viral selling NFT KTP

The statement that Kominfo oversees NFT transactions running in Indonesia was issued on the same day as the viral news that there were Indonesian netizens selling photos of identity cards (KTP) as well as selfie photos with ID cards as NFTs at OpenSea, on Sunday (16/1/2022) morning.

The sale of NFT ID cards at OpenSea went viral after a number of Facebook users complained about accounts that uploaded selfie IDs.

A number of Twitter users then re-uploaded the screenshot, which has now been widely discussed.

In a screenshot that went viral, it contained an NFT collection called “Indonesian identity card (KTP) collection”. The collection looks to consist of 38 item NFT which consists of photo of ID card, selfie photo, and selfie photo with ID card.

But when KompasTekno browse on Sunday afternoon, the collection has disappeared from the OpenSea site. We also tried to search with other keywords such as “KTP”, “KTP selfie”, and “Indonesian identity card”, but to no avail.

From searching with these keywords, we only found a photo of the cover of the ID card without information on the national identification number (NIK), name, address, and other personal information. There are also those who only sell NFT photos of their national identification numbers (NIK), without any other information.

Previously, NFT was also increasingly popular in Indonesia since the collection “Ghozali Everyday“Successfully bringing in Rp 1.5 billion in cash for its owner, Sultan Gustaf Al Ghozali.

As a result, other Indonesians flocked to follow Ghozali’s footsteps by selling selfies, food, and even non-resident cards (KTP) as NFTs in the NFT OpenSea marketplace.
