The Central Discipline Inspection Committee said on the 4th that it was revealed that he had received 4375 million yuan (about 7.5 billion won) bribes from 37 people over the 13 years from 2006 to 2019, said Zhang Jiahui, vice president of the Hainan High Court.

The People’s Daily pointed out, “It was a serious case that violated law enforcement agencies by making a favorable decision when receiving money, and undermining Chinese justice.”

– Of the 37 people who bribed Zhang Jiahui, 18 were lawyers. The remaining 19 are corporate officials and legal brokers. These lawyers approached Judge Chang on behalf of the corporation and frequently paid bribes.

In March 2019, Ding Ting, the editor-in-chief of the People’s Daily Hainan Branch, found Zhang Jiahui after losing in the first trial lawsuit in the stock transfer dispute. Afterwards, Zhang Jiahui appealed to the High Court, where Judges were judged, and Judge Zhang arranged a meeting with his fellow judge and Ding Ting. The second referee gave Ding-Ting’s hand, and he received 20 million yuan worth of shares. A few months later, Ding Ting paid two boxes of cash worth 3 million yuan (500 million won) to Zhangjiahui.

The director of Hainan Fangyuan Law Firm gave periodically hundreds of thousands of yuan (hundreds of millions of won) in exchange for help in mediating the case of the capital dispute in the Haikou branch of Ping’an Bank and the dispute between trading companies. Another lawyer also paid 1.4 million yuan (238 million won) from 2013 to 2019, including visiting Zhang Jiahui’s house every year and handing over 200,000 yuan (34 million won).

– In 2015, Hainan Taya Investment Corporation was in a situation where their land would be accepted due to a change in the government’s plan. Chairman Zhang Lin-dong, CEO of the Investment Corporation, filed a lawsuit against the Hainan provincial government because the government’s compensation standards were low.

Afterwards, he approached Judge Jang, who had maintained a relationship, and Judge Jang met with Judge Suyeong-gu Suyeong-gu, Gan Won-ping, who was in charge of the case, and asked him to raise his hand.

As a result of the lawsuit, the land compensation amount of Daaya Investment Corporation has nearly doubled from 230 million yuan (about 39.1 billion won) to 422,800 yuan (about 72.7 billion won). After the trial, Chairman Jang Lin-dong met with Judge Jang at the underground parking lot of a hotel and handed over 1 million yuan (170 million won) in return. China’s Shinbo (新京报) pointed out that “the amount of compensation has doubled at a time of greeting.”

In the case of Zhangjiahui, there were 158 pages of judgment and 37 bribes, as well as hundreds of people involved. In each case, the legal and business worlds, as well as politics and relations, were involved. In addition, it was revealed that Judge Jang was also involved in the court personnel and received money regularly.

Abuse of Superior Court Assessment Status… Pressure on junior judge

– According to the Chinese legal media’s Legislation Unbangbo, the way Judge Zhang intervened in judicial administration was “rough and varied.”

Judge Chang called the junior judges to ask for their interest in the parties involved, and warned them by discussing the disadvantages in personnel if they did not follow instructions. Judge Chang, who was vice-chairman of the High Court, was able to influence the promotion and evaluation of lower people’s courts and employees.

In its judgment against Judge Zhang, the court noted that “Zhangjiahui’s position imposes a clear influence and restraint on the handling of the case and the actions of lower court officials.”

China’s Central Discipline Inspection Committee commented, “The number of people involved and bribery are significant, and the seriousness of the situation is so serious,” and “I have been in an important position for a long time and have exploited the related supervisory and institutional loopholes.”
