Jama A. cleared of killing disabled Dimitri, but jailed for robbery | Inland

Two weeks before Dimitri’s death, A., who has several convictions for serious violent crimes, suddenly stood screaming for money in the bedroom of an 87-year-old man. A. dragged him into the living room and forced him, under threat of presumably a crowbar, to hand over money.

According to the court, it cannot be proven that A. killed Dimitri with great violence on 8 August 2020 in Nibbixwoud, and then dumped him in a ditch with his scooter. That evening Dimitri had gone out with Jama A. in Hoorn. It was soon clear to the police, due to the extensive injuries on the body, that Dimitri must have been violently killed.

After the night out, A. and Dimitri had driven from Hoorn to Nibbixwoud on the scooter. Camera images show that a scooter is driving towards a ditch. The court does not agree with the position of the Public Prosecution Service that only A. can be the perpetrator who can be seen in the images.

Because A. stated that he had been at home at the time of the murder, the court ordered an additional investigation into A.’s telephone by the Netherlands Forensic Institute. The NFI considers it plausible that the telephone may have radiated A.’s router at home. Therefore, the court concludes that “it cannot be established beyond reasonable doubt” that Jama A. was involved in the death of Dimitri. He was therefore acquitted of that fact.

Victim lawyer Priya Soukhai speaks of “indescribable sadness and disappointment” among the relatives of Dimitri: “In our view there is overwhelming evidence and that is why we did not see an acquittal. Our hopes are now pinned on an appeal from the Public Prosecution Service. There are enough leads to get this suspect convicted at the court.”

The Public Prosecution Service has fourteen days to appeal the verdict.
