In the long list of bonus provided for the emergency by COVID-19 is added on lump sum contribution recognized by the Forensic Fund to lawyers by way of reimbursement of costs of legal activity in the period of lockdown.
In these hours the Forensic Fund has published a extraordinary call (which you can download at the end of the article) for the assignment of a one-off contribution ranging from a minimum of 300 euro to a maximum of 1,2000 euros. A contribution that reimburses legal professionals for the costs of the legal activity incurred also during the lockdown period, the amount of which will be calculated taking into account the difference between the VAT turnover and the IRPEF income.
There is time to apply for this extraordinary contribution until 23 July 2020 and below we will explain the procedure. In the meantime, let’s see what i am requirements to benefit from the lawyers bonus of 1,200 euros (which we remember to be the maximum value).
Extraordinary lawyer bonus (COVID-19): who is it for?
The Forensic Fund – in the context of the services in support of the profession provided for in the regulation – taking into account the current emergency situation from COVID-19 has called a extraordinary call for the assignment of lump-sum contributions for the reimbursement of costs for the legal activity.
In detail, the announcement – for which they were allocated 2 million and 500 thousand euros – is aimed at both lawyers that ai practitioners which as of 31 December 2019 were registered in the Cassa. Furthermore, it is necessary that these have not been suspended – pursuant to article 20 of law No. 247/12 – nor have they been canceled from the Register / Register of practicing lawyers.
However, they cannot apply of the bonus those lawyers who have benefited from the 600 euro bonuses paid for the months of March and April by way of “income of last resort“. The same applies to those who are usefully included in the ranking of extraordinary calls to Law No. 1/2020 for the assignment of contributions for lease payments of the law firm for natural persons conductors or for the assignment of contributions for lease payments of the law firm for legal persons or for the assignment of contributions for the purchase of IT tools for the law firm.
Furthermore, in order to apply for the contribution, it is necessary to be in compliance with the prescribed income communications to the Cassa at the date of publication of the notice.
For those who have been excluded from the aforementioned bonuses and therefore have not received anything as required by the Cura Italia Decree and by the Relaunch Decree, 2 million and 500 thousand euros have been allocated to recognize a contribution equal to 15% of the difference between the turnover of VAT and income tax income declared with Mod5 / 2019. Exceptionally, for those who enrolled in the Forensic Fund only in 2019, this contribution will be calculated on the basis of the 2019 income data which must be declared when applying.
In any case, as already anticipated, the amount of the contribution cannot be less than 300,00€, let alone overcome the 1.200€.
How to claim the bonus COVID-19 lawyers
The application must be sent by 24:00 of the July 23, 2020, under penalty of inadmissibility thereof. The request must be submitted exclusively electronically using the specific online procedure available in the personal area of the Cassa Forensic website.
The application must be accompanied by theself-certification of income data for 2018 (where required); in case of lack, incompleteness or irregularity of the formal elements of the application and of the declarations made, also by third parties, the applicant will have 15 days of time to add what is required.
Finally, the Forensic Fund wishes to clarify that for the The ranking order will not be taken into account.
