Hit by a car after you had to brake hard due to the low hanging sun: who is liable? | My guide

IndependentWe can expect a lot of sun this week. That is good, but it also creates extra risks when you have to go on the track. After all, the sun hangs low during the winter period, which seriously complicates visibility while driving. A rear-end collision quickly happened. Determining who is liable for the damage can then be difficult. Independer.be therefore list four possible collisions – and their consequences.

1. Hit from behind after sudden hard braking

Suppose you have to brake suddenly, causing the vehicle behind you to collide with your car. Who is then liable for the damage? Such a collision often occurs because the person driving behind you does not keep enough distance. After all, as a driver you always have to make sure that you are not too close behind your predecessor. Did your car behind you not keep enough distance? Then in most cases he is liable for the damage.

But there are exceptions. Because did you brake without need? Or did you cut off your car behind while overtaking? Then you are the one at fault and you are therefore liable for the damage.

2. Hit from behind after overtaking

The situation: on a busy highway you overtake someone. As soon as you drive in the right lane again, the vehicle behind you will crash into your car. It may be that the driver behind you stepped on the gas even more instead of braking. In that case, the driver behind is of course liable.

But did you give the other driver too little space and cut him off? Then you are responsible yourself. The driver can therefore hold you liable for this. For this he must be able to prove that you actually cut him off.

Who pays for the damage after an accident: you or your insurer?
That depends on whether you have opted for civil liability insurance, a mini-omnium or a full-omnium. Read here what you should pay attention to when taking out your car insurance.

3. Hit from behind at a traffic light

Suppose you are approaching a green traffic light that changes to orange. You quickly hit the brakes. Your vehicle behind does not brake (or brakes too late). Who is liable? The following also applies in this situation: the vehicle behind you must keep a sufficient distance. Was he driving too close behind you? Then he is responsible for the damage.

Were you already on the brakes while you were still a long way from the traffic light? Or did you already drive past the traffic light, so you could no longer stop safely? Then you can be held liable.

4. Hit from behind in traffic jam

The situation: you are standing still in a traffic jam and are suddenly hit from behind. This causes you to collide with your predecessor. Because you were stationary, your vehicle behind is liable in this case for both your damage and that of the vehicle in front.

What if you had been driving at the time of the collision? Then you could be held liable for the damage to the car in front of you.
