Guillaume Delbar and his convicted deputies, can they keep their elected seats at the town hall of Roubaix?
The sanction has fallen, what will be the consequences? This Thursday, December 2, 2021, the judicial tribunal of Little condemned Guillaume Delbar, mayor of Roubaix, to six months suspended prison sentence and two years of ineligibility. In view of this condemnation, can he remain mayor?
The mayor and two convicted deputies
This Thursday, the court therefore issued its decision in the organized gang fraud case which targeted the various right-wing mayor of Roubaix and a dozen of his relatives, including deputies.
Guillaume Delbar received a six-month suspended prison sentence, a 3,000 euro fine and two years of ineligibility. His first deputy Max-André Pick was sentenced to 18 months in prison, six of which was suspended and three years of ineligibility. Another elected official condemned, Karima Zouggagh, who receives a one-year suspended prison sentence and two years of ineligibility.
Concretely, the mayor and his deputies are therefore condemned to abandon their elected mandates to the City, the Department or the Metropolis.
Ineligible but …
However, defendants still have the possibility of appeal the judgment delivered this Thursday. This is also the case with Guillaume Delbar.
The court could possibly attach this sentence to a provisional execution, that is to say the application of ineligibility pending the possible judgment on appeal.
Or, the judge did not pronounce the provisional execution of this trouble. Guillaume Delbar and his assistants can therefore keep their seats pending a possible appeal judgment.
If the ineligibility is again pronounced on appeal, then the elected officials will have to resign.
For the record, Max-André Pick and Karima Zouggagh had been withdrawn from their delegations to the Department of the North following this affair. Guillaume Delbar had chosen him to remain in his post of mayor while awaiting deliberation.
