Nevada Supreme Court Stands Firm in Jon Gruden Lawsuit Against NFL
Las vegas, NV – October 2, 2025 – The Nevada Supreme Court on Thursday unanimously denied the NFL’s request for a rehearing regarding its August decision in the lawsuit brought by former Las vegas Raiders coach Jon Gruden. The court’s order leaves the NFL with limited legal options.
All seven justices affirmed the previous ruling, which stated the league could not compel Gruden into arbitration overseen by NFL Commissioner Roger Goodell in his claim that the NFL leaked damaging emails to the media prior to his 2021 resignation.
Sources familiar with the situation indicate the NFL is likely to appeal to the U.S. Supreme Court, though a league spokesperson declined to comment on Thursday evening.
In August, the Nevada Supreme Court, in a 5-2 decision, did not rule on weather the NFL actually leaked Gruden’s emails. However,the majority opinion found the league’s attempt to force arbitration was “unconscionable,” arguing that gruden,as a former employee,should not be bound by the NFL Constitution’s arbitration clause. The court stated that applying the clause to former employees would grant the Commissioner undue control over dispute resolution.
Gruden’s lawsuit alleges that Goodell and the NFL pressured the Raiders to terminate his employment by selectively releasing emails containing offensive language - including racist, sexist, and anti-gay remarks – that Gruden had written during his time as an ESPN analyst.
Gruden resigned from his position with the Raiders in November 2021, having led the team’s relocation from Oakland to Las Vegas in 2020. He is seeking monetary damages, claiming the targeted release of the emails and subsequent publication in The Wall Street Journal and The New York Times caused significant harm to his career and endorsement opportunities.
Adam Hosmer-Henner, Gruden’s attorney, expressed satisfaction with the court’s decision. Gruden himself was not available for comment.
Following the August ruling,Gruden told ESPN the leaked emails disrupted the Raiders’ 2021 season,leading owner Mark Davis to request his resignation after a 3-1 start. He stated his goal is to reveal the truth and prevent similar situations from occurring in the future, asserting that the actions taken against him were unjust and deserved scrutiny.
