The CPC JUAN MANUEL FRANCO GALLARDO, a member of the Fiscal Commission, carried out an analysis regarding the “FINANCIAL EFFECTS OF THE ELIMINATION OF THE UNIVERSAL COMPENSATION OF THE BALANCES IN FAVOR OF THE FEDERAL TAXES”.

The Universal Compensation of balances in favor of federal taxes is a way to extinguish obligations, which means that tax payers are not affected in their cash flow, since otherwise they may become undercapitalized. For this reason, it is recommended that the Executive Branch submit for the consideration of the Legislative Branch (Congress of the Union) the modification of the Federal Tax Code (CFF) in order to ensure that the Universal Compensation of federal taxes is reincorporated into said Code. . The purpose of this work is to publicize the problem that tax payers have due to the elimination of Universal Compensation, which was in force until December 31, 2018 and, above all, to suggest that the aforementioned be incorporated again option.

From December 31, 1981, the day the new CFF was published in its article 23, and until December 31, 2003, it had allowed taxpayers to offset their balances in favor derived from federal taxes against taxes payable by the taxpayer derived from the same contribution, as well as against the withholdings made including its accessories.
