xAI Lawsuit Against Apple and OpenAI Advances, Seeks Evidence from South Korea
SAN FRANCISCO, CA – November 20, 2025 – xAI, Elon Musk’s artificial intelligence company, is continuing its legal battle against Apple and OpenAI, with recent court filings revealing a request for evidence from an unidentified entity in South Korea. The lawsuit stems from xAI’s claim that Apple’s partnership with OpenAI creates an unfair competitive environment within the App Store, hindering the success of other AI applications like Grok, which reportedly failed to reach the top of the App Store charts following a feature update.
Apple has rejected Musk’s accusation of antitrust violations. Initially, Apple and OpenAI attempted to have the case dismissed, but that request was denied on November 13, 2025, with the judge requesting additional documentation.
The court has granted Apple and openai an extension until December 11, 2025, to file their response. Simultaneously, xAI has secured a court order to obtain evidence from a South Korean entity through the Hague Convention on the Taking of Evidence Abroad in Civil or Commercial Matters.
While the specific South Korean company remains undisclosed, potential targets include Samsung or SK Hynix, both of which supply AI infrastructure to OpenAI, or Kakao, which recently integrated ChatGPT into its widely-used KakaoTalk superapp. The court has approved a Letter of Request,translated into Korean,to be sent to the National Court Administration of the Republic of Korea.
