According to El Comercio, it was the supreme prosecutor Víctor Rodríguez Monteza, who issued the opinion before the Supreme Court that will analyze the requirement.

This morning, the Permanent Supreme Criminal Chamber of the Supreme Court He decided to reschedule the hearing to evaluate the extradition request. This, because the lawyer Roberto Su, legal defense of Toledo and Karp, had been denied the floor.

This decision was warned by the presidency of the court, which ordered that the legal defense of lawyers be authorized and that the hearing be public. The attorney Su Rivadeneyra and the deputy prosecutor of the Supreme Criminal Prosecutor’s Office had gone to the stage.

The due diligence hearing was rescheduled for February 26 at 8:30 in the morning.

If the request was admitted, it would be the second extradition process to which Toledo Manrique could be submitted to the United States justice. While, in the case of Karp, it would be the first order.

-The case they must face-

According to the indictment made by the Lava Jato Special Team, former President Alejandro Toledo, during his tenure between 2001-2006, Toledo Manrique would have committed acts of corruption in favor of the company Odebrecht and Camargo Correa who benefited from the tender of the South Interoceanic Highway, sections 2, 3 and 4.

Said amounts of money would have been paid through the companies of the Israeli Peruvian businessman Josef Maiman, today benefiting from effective collaboration. A few weeks ago, an early trial hearing was held in which the businessman confirmed that he received the money from the alleged bribe at the request of the former head of state.

Some of the money was subsequently deposited in offshore companies incorporated in Costa Rica; among them Ecoteva Consulting Group chaired by Eva Fernenbug, mother-in-law Toledo.

The money was transferred to Peru and invested in the purchase of real estate and mortgage payments of the Toledo Karp family. For the housing located in Las Casuarinas (Surco), the sum of US $ 3,737,215.00 was paid, for the office and deposits in the Omega Tower (Surco) a total of US $ 882,400.00.

In addition, the payment of US $ 217,007.18 was made for the mortgage of the Camacho house (La Molina) and an amount of US $ 277,308.96 for the mortgage of the beach house of Punta Sal (Tumbes).

“Given the receipt of the present request for active extradition of the extraditable Alejandro Toledo Manrique, the records were reviewed, in accordance with article 02, subsection 4 of the Organic Law of the Public Prosecutor’s Office, transfer to the Supreme Criminal Prosecutor and to the procedural subjects presented: date of hearing for the knowledge of the extraditable ”, is indicated in the judicial document.

As recalled, last June, the prosecution filed charges against Alejandro Toledo, Karp and Dan On for the alleged crime of money laundering in aggravated mode and requested for the three 16 years and eight months in jail.

He also accused Shai Dan On (son of Avraham Dan On) for the same offense for which he asked for 13 years and four months, against the lawyer David Eskanazi requested 13 years and 4 months; while for Eva Fernenbug (mother-in-law of Toledo) 10 years in jail.

-They will request return of the file-

When the date of the hearing was known, Roberto Su Rivadeneyra, lawyer for Alejandro Toledo He said they will ask the supreme court to return the extradition file to the upper court that will carry out the oral trial, since there have been several orders that were raised during the process.

“Several procedural vices have been committed in this case. For example, we have asked for the cessation of the preventive detention of the Ecoteva case and it has not been resolved. We have asked for the nullity of the resolution to be declared inadmissible, and it was not resolved either. So, how is it that by not resolving issues that are linked to extradition, the court handles the tax request, ”said the lawyer.

Therefore, he considered that his requests must first be resolved before the extradition requirement in the Supreme Court is assessed.

If approved, the extradition booklets will be formed for each of the required and must be sent to the United States to undergo the same verification process before being referred to a federal judge.
