DPR Baleg: This is the first time when a law is typed wrongly after being signed by the president

JAKARTA, KOMPAS.com – Chairman of the Legislation Body (Baleg) DPR Supratman Andi Agtas stated that the DPR would communicate with the government to correct the omission of internal writing Work Creation Act.

Supratman emphasized that the DPR is ready to take responsibility that these improvements do not change the substance of the law.

“The DPR is ready to do that and is ready to be accountable that this does not change the substance of the Job Creation Law at all. Because it is purely an administrative error,” Supratman said when contacted, Wednesday (4/11/2020).

According to him, the writing error that occurred in Article 6 and Article 175 point 6 is still possible to be corrected.

Supratman said that correcting typos in the text of the law has become a concession in itself.

Although it is not explicitly regulated in Law Number 12 Year 2011 concerning the Formation of Legislation, he said there was an agreement that revisions to the Law after it was passed may be made as long as it does not change the substance.

“The PPP Law does not explicitly regulate. What we agree is that there should be no changes after the completion of the plenary session in terms of substance. But editorial improvements have been made, it has always been like that,” said Supratman.

Nevertheless, Supratman admitted that this was the first time that the negligence of writing in the law was discovered after being signed by the president.

In previous cases, negligence was discovered before the president signed it. However, he considered that corrections to word errors were commonplace.

Moreover, the negligence of writing in the Job Creation Law is considered as an administrative error.

“Indeed, after being signed by the president, this is the first time it has been done, but before the president signs, almost all laws are like that. Because the State Secretary has to read it first. So a mechanism called typo correction and so on is always carried out,” he said.

Previously, Minister of State Secretary Pratikno said that he had asked the DPR Secretariat General to respond to the improvement of Law Number 11 of 2020 concerning Job Creation.

This was conveyed by Pratikno in response to a typo in the Job Creation Law.

“The State Secretariat Ministry has also conveyed to the DPR Secretariat General to agree on the repairs,” said Pratikno in a press statement, Tuesday (3/11/2020).

Pratikno also considered that the formulation error in the Job Creation Law was only limited to administrative problems. He ensured that the mistake did not affect the implementation of the Job Creation Law.

Meanwhile, Constitutional Law Observer Bivitri Susanti stated that writing errors in the Job Creation Law cannot be corrected carelessly.

He urged the government to issue a government regulation in lieu of laws (perppu) to provide legal certainty so that these articles can be implemented.

“If the government wants to provide legal certainty so that the articles can be implemented, it can issue a Perppu. Because this law cannot be changed just like that,” said Bivitri, Tuesday (3/11/2020).
