Who removed the beaver dams in the course of the Leinachbach? Conservationists are concerned because a responsible person has not yet been found.

What the district groups Würzburg and Main-Spessart of the Bund Naturschutz (BN) have been observing for some time has recently been confirmed in the course of the Leinachbach between the municipalities of Leinach and Zellingen. Here, too, beavers had worked as builders, built dams and dug buildings into the adjacent bank below the pent-up water surface. After removal of at least three beaver dams in the course of the Leinachbach on the Zellingen market, the entrances to the boilers are now free.
For Steffen Jodl, the managing director of the federal government stands in stark contrast to the applicable European law that the removal of beaver dams on water on the Leinach, which obviously took a great deal of effort, is legitimized by the Ordinance on the Protection of Species (AAV). “That is why there is no legal means to act against such measures,” regrets Jodl.

In a press release, BN district chairman Armin Amrehn is “shocked by the repeated and massive interventions.” In addition, Erwin Scheiner, chairman of the BN district group Main-Spessart, comments: “Not only was a dam torn down on the Leinach, but an entire habitat was destroyed. Access to the boiler, which is actually safe from enemies, is exposed by the lowering of the water level. Fuchs and stone martens then have access to young animals that can be in the boiler. ” However, the nature conservation authorities are helpless in the Exceptional Ordinance on Species Protection Law issued by the Bavarian Ministry of the Environment.

BN passers-by Steffen Jodl had been made aware of the removal of beaver dams on Leinachbach. The procedure itself remains suspicious. The area in the course of the Leinachbach, in which until recently there were at least three dams, concerns the district of the Zellingen market. In the building department of the town hall there, at least the acquis could be clarified. While in the area of the community of Leinach it is a so-called residential stream, the stream and the adjacent bank strips in the area of the Zellingen market are owned by the community.
Who is mowing in the area?
According to information provided by the local administration, there is no order to remove the beaver dams from the building yard in Zellingen, which is therefore responsible. During the course of the research by this editorial team, it was also not possible to determine who was mowing the two banks in parallel. Also, the demand from an organic farmer who manages the adjacent agricultural areas did not reveal any information about the process. “Everyone knows that there are beaver dams there. But I didn’t notice any removal,” said the farmer.
Due to traces along the shore, Steffen Jodl hopes that despite the removed dams and exposed boilers, there will still be a beaver in the area. “The beavers’ dam and living space form a unity as a habitat, which are basically protected from destruction by paragraph 44 of the Federal Nature Conservation Act – if there were no Bavarian Exemption Ordinance (AAV) to undermine this protection. It does not take into account that beavers to build dwellings in the banks and not just raise their young in beaver castles. The BN therefore calls for an urgent change, “explains Jodl emphatically.
About the regulation
Among other things, the ordinance on the admission of exemptions from the protective regulations for specially protected animal and plant species states: “In order to avert significant economic damage, in the interest of human health and for reasons of public security, in accordance with paragraphs 2 to 7 notwithstanding section 44 (1) nos. 1 and 2 BNatSchG, it is permitted to re-enact beavers (castor fiber) from September 1 to March 15, to catch and kill them and 3 BNatSchG, beaver dams, as far as occupied beaver castles are not affected, and beaver castles not occupied may be removed. “
