Daimler vs. Nokia: decision in patent war postponed – economy

The automaker Daimler is defending itself in court. He is supposed to pay a multiple of what mobile phone manufacturers are charged for patents in the field of mobile communications.

Munich – The trial date in the patent war between Daimler and Nokia before the Munich district court has been postponed. Originally, it was expected that a judgment would be given on Wednesday. Nokia demands from Daimler for the use of basic patents in the field of mobile telephony a multiple of what cell phone manufacturers have to pay. The new date is now July 23rd.

New appointment in July

The Finnish company Nokia still holds important patents for mobile phone calls from times when it was a big number as a cell phone manufacturer. Car manufacturers like Daimler rely on the use of the patents. New vehicles are already equipped with cellular technology without exception. If mobility gets semi-autonomous elements in the future – especially after the switch to 5G – even more mobile radio technology should be used in cars.

Daimler defends against what he sees as excessive claims on the part of Nokia, referring to the case law of the European Court of Justice. Accordingly, basic patents, so-called standard essential patents, must be given to all interested parties on fair, reasonable and non-discriminatory terms.


Companies want legal certainty

Several suppliers, such as Bosch and Continental, support Daimler’s lawsuit. You want to get the license to use the patents yourself in order to have legal certainty for the development of further products. Nokia told our newspaper: “Nokia has always made fair licensing offers in a wide range of ways – this applies to both Daimler and its suppliers.”
