Covid-19: the CNOPS refuses any reimbursement of costs

In a memorandum sent on August 12 to the departments concerned, the Director of the CNOPS (Caisse Nationale des Organismes de Prévoyance Sociale) informed them that “the costs of diagnostic and therapeutic services linked to the COVID-19 pandemic , whether it is biological analyzes, diagnostic and follow-up radiological examinations, hospital stays as well as drugs, are not reimbursed by the CNOPS ”.

The body which covers state administrations, local communities, public establishments, legal persons governed by public law and bodies managing the public sector staff pension scheme has therefore decided to distance itself from the health crisis. which puts the nerves on edge and the psychological health to the test.
The note to mutuals, to the Medical Control department, to the Service Liquidation department, to the Audit and Management Control department, to the Studies and Actuarial Department, to the Federated Mutuals at the CNOPS, to the Division of Communication, to the Legal Affairs Division, adds that “the Covid-19 pandemic is identified as being a force majeure in accordance with the provisions of articles 95, 268 and 269 of the dahir on the code of obligations and contracts”. Therefore, this pandemic is also one of the diseases of an epidemic nature exempt from the remuneration of services and benefits provided by hospitals and services under the Ministry of Health in accordance with the order of the Minister of Health n ° 2284-05 of 4 choual 1426 (November 7, 2005), specifies the note. Adding that “it does not appear among the components of the priority health program giving right to reimbursement and payment of the related care by the managing bodies in accordance with the provisions of article 7 of law 65-00 on the code of basic medical coverage.

The position of the CNOPS is clear. However, one can always wonder why such a release now. The rise of detected cases as well as the number of deaths which accumulates pushed the organization to make this exit to save its cases? Has the demand for reimbursement become so strong that it had to be stopped? Then, what about the duty of solidarity and mutual efforts to which Le Souverain appealed to all Moroccans in the face of this unprecedented situation.
