The Council of State has rejected the appeal of the Brussels police commissioner Pierre Vandersmissen against his temporary suspension. The Council of State announced this on Monday.

Vandersmissen, director of interventions at the Brussels-Capital-Ixelles police zone, was temporarily removed from office after doubts were raised about his actions against a citizen who illegally possessed tear gas during a demonstration on September 13. He has been temporarily transferred to a different management.

Vandersmissen had initiated emergency proceedings at the Council of State to challenge the measure. According to the Commissioner, “his honor and reputation” have been tarnished, but he is not being heard. The Council of State ruled on Monday that “that infringement, provided that it is established and that it is the result of the contested act, is not serious or irreversible to the extent that it would justify the urgent treatment required for the can suspend action “.
