CÔTE-D’OR: The anti-rapprochement bracelet added to the arsenal of fight against domestic violence

Experimented last fall in a few jurisdictions in France, the anti-reconciliation bracelet can now be used in the jurisdiction of Dijon. A local protocol was signed and reaffirms the transversal policy carried out in the fight against domestic violence in Côte-d’Or.


Permitted by the law of December 28, 2019, the anti-reconciliation bracelet aims to protect people who suffer from domestic violence and more serious by means of a device making it possible to geolocate a person to be protected as well as a real or suspected perpetrator of violence. conjugal.
Its implementation having been defined by an application circular of September 23, 2020, the device was launched at the Pontoise judicial court on September 24, before being then tested, in October, in the courts of Bobigny, Douai, Aix-en-Provence and Angoulême.

Since this Tuesday, January 19, 2021, it can be used in the jurisdiction of Dijon in Côte-d’Or. The signing of a protocol stipulating the conditions for the implementation of the BAR was formalized at the judicial city of Dijon, between the State, the judicial tribunal of Dijon, the Departmental Directorate of Public Security of Côte-d’Or, the Burgundy-Franche-Comté Gendarmerie region, the Côte-d’Or penitentiary integration and probation service and the France Victimes 21 victim support association.

Cross-cutting policy and complementary tool

President of the Dijon judicial tribunal, Bruno Laplane sees in this signature “the appropriation by local actors of public policy against marital and intra-family violence”, not failing to note that it is also a policy jurisdiction initiated by the prosecution, but “shared between civil and criminal actors for a better adaptation of measures to the circumstances, backgrounds and personalities of the perpetrator and the victim”.
In this sense, the signed protocol makes it possible to formalize a transversal policy, which “requires an effective coordination of the actors” underlines Eric Mathais, public prosecutor of Dijon.

The magistrate insists there on the implementation of “one of the flagship measures of the Grenelle domestic violence, with a very strong dimension of victim protection”. The BAR is “complementary to the means of action already existing in the jurisdiction of Dijon”. Eric Mathais recalls in particular that the eviction of the violent spouse is possible since the implementation of the departmental plan to fight against violence against women but also that the serious danger telephones (TGD) are today 12 in the prosecutor’s office of Dijon.
Since January 2021, Marie-Pierre Bouhey is vice-prosecutor of the domestic violence pole at the Dijon prosecutor’s office.

Applications in civil and criminal matters

“It is the strongest response, the most restrictive and the most protective in matters of domestic violence”, supports Bruno Laplane regarding the anti-reconciliation bracelet.

The installation of the BAR can follow a protection order issued by the family court judge. Due to the civil framework, an agreement between the two parties is necessary. On the other hand on the penal level, this pose can be decided by the president of the judicial court or his delegate in the case of penal compositions which are alternatives to legal proceedings. It is then a rapid response, which can be applied 48 hours after the act of violence.

The BAR can be implemented within the framework of a measure of judicial control decided by the judge of freedoms and detention, following a sanction pronounced by the correctional judge or still under the monitoring of the sentence pronounced and the case its adjustment by the penalty enforcement judge.

Three anti-reconciliation bracelets in Côte-d’Or

Regarding the technical and operational aspects of the BAR, it is to summarize a mobile electronic surveillance materialized by a bracelet placed on the perpetrator of domestic violence and two tracers (mobile phones), one given to the perpetrator. and the other for the victim, with permanent geolocation in real time.

Alert and pre-alert zones are defined. The alert zone cannot be less than a radius of one kilometer and can extend up to 10 kilometers. If the perpetrator enters these areas, he is contacted by the device provider who informs him that he must leave the area. In case of refusal to comply, the police are then contacted for an arrest. The victim is contacted to tell him that safety is advised. On his tracker, the victim can also receive alert messages and has an SOS button in case of danger.
