Corona in Munich: Dealers rehearse uprising: Lawsuit against emergency brake in planning – “state arbitrariness”

The corona measures hit the retail sector particularly hard. This also applies to the federal emergency brake in the room. Now resistance is forming in the industry.

Munich – Yawning emptiness far and wide – this is what it currently looks like on most days in Munich * city center. Only a few small queues form in front of the shops. Mainly because of the obligation to test. A real shopping mood may not arise there. The numbers are shocking: 30 percent fewer people were out and about in Kaufingerstrasse on Thursday than in the previous week – and 80 percent fewer than in the comparable period in 2020!

The constantly changing corona measures are to blame. “Nobody knows their way around anymore,” says Wolfgang Fischer, head of the CityPartner association of Munich city center retailers. Now customers also have to show a negative quick test if they want to go to a store with an appointment. “Nobody does a test for a book or barbecue tongs,” says Fischer. “That is then ordered online.”

Should the nationwide emergency brake from the Chancellor Angela Merkel (CDU) come, the trade would have to close again nationwide from an incidence of over 100. The initiative “Dealers Help Dealers” now wants to take legal action against it the Infection Protection Act Action. “We see an absolute unequal treatment in all areas,” said Marcus Diekmann, initiator and boss of Rose Bikes. “There is no obligation to work from home, but trade and gastronomy should be banned and you can only meet one person in private,” he criticizes.

Participating in the initiative include the sports retail group Intersport, fashion retailers, but also restaurateurs such as the L’Osteria chain. With the introduction of the nationwide emergency brake, they would now have the opportunity to take uniform nationwide action against this “state arbitrariness”, said Diekmann. The corresponding amendment to the Infection Protection Act is to be decided in the Bundestag on Wednesday.

Wolfgang Fischer is watching the initiative’s approach with great interest. “We expressly welcome anything that creates a uniform and, above all, sensible solution at the federal level,” said Fischer. Like the initiative, he also criticizes the unequal treatment of individual retail sectors in the planned law. While the textile trade has to plan 40 square meters per customer, in the supermarket it is only 10. And yet, despite the lower risk of infection, the textile business must close when the incidence is 100 or more. “It all makes little sense.” (L.
