– Prosecutor General Yoon Seok-yeol, who returned to office due to the court’s decision to suspend the disposition of’two-month suspension’, went to the Supreme Prosecutors’ Office on the 25th even on Christmas holidays. On the afternoon of the 16th, when the disciplinary action was confirmed at the home of President Moon Jae-in, Yoon did not go to work the next day, but arrived at the Supreme Prosecutors’ Office on the 9th at about 12:10 p.m. On this day, General Prosecutor Nam-gwan Cho and Secretary General Bok Doo-gyu had lunch with lunch boxes and discussed measures against the new coronavirus infection.

Earlier, on the 16th, the Prosecutor and Discipline Committee of the Ministry of Justice decided on a two-month suspension to President Yoon. However, on the 24th, the Seoul Administrative Court cited the request for suspension of the enforcement of the effective disciplinary action filed against Minister of Justice Choo Mi-ae by President Yun, saying, “The lawsuit will be suspended until the 30th day from the date of the decision.” Considering that the ruling on the main bill cannot be reached until July of next year, when Yoon’s term ends, the discipline of President Yoon was virtually eliminated.

When the court decision was made, Yoon said, “I am deeply grateful for the judgment of the judiciary,” and “I will do my best to uphold the spirit of the constitution, rule of law, and common sense.” On the 1st, when the administrative court accepted the suspension of duties, the Supreme Prosecutors’ Office said, “As a Korean public official, I promise to do my best to protect the constitutional spirit and rule of law.” At the time, it was the seventh day after Minister Chu’s order to suspend his job on the 25th of last month.

Seok-yeol Yoon went to work after 9 days “I will do my best to protect the constitutional spirit, rule of law, and common sense”

Regarding the words’common sense’ in addition to’constitutional spirit’ and’lawism’ while President Yoon went to work 9 days after the 17th, inside and outside the prosecution, “the disciplinary process was outside of common sense, and the court that recognized it. Didn’t you have sent a message to”

Regarding the disciplinary proceedings, the court judged that the disciplinary decision itself was invalid because there was an obvious defect in the decision process to evade the disciplinary committee that General Yoon requested by the Prosecutor and Disciplinary Committee of the Ministry of Justice. He said, “In addition to the fact that there is a flaw in the resolution process for an application for refusal, it is difficult to conclude that there is no possibility of winning the claim by the applicant in the end.” It was pointed out that the quorum of votes to be avoided is that the majority of the enrolled members must attend 4 or more, but in some votes, only 3 people participated in the decision to dismiss.

An incumbent prosecutor said, “The most talked about in this phase is’Is this common sense?'” and said, “The reason why Minister Choo Mi-ae suffered three defeats in three matches following the decision of the Supreme Court and the first administrative court.” A criminal law expert who requested anonymity analyzed that “the court pointed out that the disciplinary action was invalid because the quorum was not satisfied. .

Prosecutors’ executives also thought of American thinker Thomas Paine in the word’common sense’

A prosecution officer who was relegated to the province after assisting General Yoon in his aide recalled the American thinker Thomas Paine (1737-1809) with the word’common sense’. In his book Common Sense, Paine criticized the monarchy and guided the Republic of Korea as the only way America is going. He argued that “the British monarchy and aristocratic premise that protects the privileged class is contrary to the common sense that’all human beings are equal’.”

The executive pointed out that “the value of the republic lies in the separation of powers that value individual freedom, but the value of common sense, which was taken for granted at 200 years after Paine’s death, is falling.” In addition, he said, “The result of the trial against Professor Kyung-Shim Chung of Tong Yang University held on the 23rd is also a remark that came from the purpose of keeping common sense now.”

With Yoon’s return, the Wolsong nuclear power plant suspicion and the Lime/Optimus asset management fund fraud case are expected to reinforce the investigation of political affairs with the superiors. The summons investigation of key officials in the alleged case, including former Minister of Industry Paik Woon-gyu and Chee Hee-bong, then the Blue House Industrial Policy Secretary (currently the President of the Korea Gas Corporation), is expected to be conducted soon. Regarding Lime and Optimus, the investigation could be expanded due to suspicion of involvement by passport politicians.
