Cologne: Judge lifts arrest warrant in case of rape

The prosecution also accuses the restaurant owner of facilitating, rather than preventing, the alleged rape. The witness had said that she had not known the man before. In the process it emerged that the trio had apparently been on vacation together in Holland. According to the defendants, there should also have been sexual acts there. The witness cited gaps in her memory that she had memory problems after falling on her head.

The ex-girlfriend of the alleged victim said the 23-year-old was vying for attention and sometimes inventing things in this context. A brain tumor, for example. Her mother became clearer and suspected that the rape had been invented to save the broken relationship with her daughter.

This was enough for the judge to ultimately deny the urgent suspicion of the accused. “If we overturn the arrest warrant, it translates as: acquittal,” Roellenbleck had previously said, but the trial will continue for the time being. The 23-year-old is now threatened with an investigation himself, for example for false testimony, false suspicion or, since her uncle was in custody, even deprivation of liberty.
