Hollywood Reporter and Reuters now reports that assistant director Mamie Mitchell is going to court with accusations that according to the script, shots should never have fallen during the relevant scene it was rehearsed on when the catastrophic thing happened.

It was according to Hollywood Reporter Mitchell who called the emergency number then panic erupted:

Baldwin shot and killed the 42-year-old cinematographer Halyna Hutchins by accident.

The director was also injured by the same shot. Mitchell holds Baldwin and the other “Rust” producers accountable. It appears from the documents, where it also becomes clear that the plaintiff is represented by celebrity lawyer Gloria Allred.

The lawsuit states that three close-ups were to be filmed, one of Baldwin’s eyes, another of a “blood stain” – and the third of Baldwin’s upper body while he grabbed the weapon in the holster on his hip.

«There is nothing in the script that the weapon should be fired by either Baldwin or anyone else», It is stated in the court documents.

Mitchell explained at the press conference that she has worked in the industry for 40 years and many times worked with weapons on film sets. She said she had never experienced anything like what happened during the “Rust” recording.

Mitchell is demanding financial compensation, not knowing how much, also for the emotional damage she has sustained after the incident. She was standing right next to Hutchins when the shots fell. It is claimed in the lawsuit that Mitchell will not be able to work indefinitely.

Santa Fe police are still investigating. They have previously stated that it is not unlikely that anyone could be charged.

Baldwin has stated that he was in shock that the weapon was loaded. He has not commented on the lawsuits.
