The City of Geneva will not appeal to the Federal Court against the recent decision of the Administrative Chamber of the Court of Justice. She will transmit the financial control compliance audit report on the expense reports of municipal employees, after having redacted it.

“We will submit to the court decision,” said administrative counselor Sandrine Salerno on Wednesday, interviewed by Keystone-ATS. In a judgment of April 30, the Administrative Chamber partially admitted the appeal of Vincent Latapie, president of the PLR City of Geneva and lawyer, who acted in his own name against the refusal of the executive to transmit this report to him.

The “Tribune de Genève” also complained to the cantonal data protection officer. The latter had recommended the transmission of the report, in the name of the law on public information, access to documents and protection of personal data (LIPAD).

Justice has established the list of redactions to protect the identity of employees. This report was sent to the 80 municipal councilors in December 2018, a month after the damning audit of the Court of Auditors on the expense accounts of the executive. The publication of elements in the press had prompted the Administrative Council to file a complaint for breach of professional secrecy.
