Brexit, the EU wants to sue London. “Withdraw the Northern Ireland law or let’s go to the Court of Justice”

The crux of the dispute over the law presented yesterday in Parliament in Westminster by the government of Boris Johnson: it calls into question the Brexit agreement reached at the end of last year, which provided that theNorthern Ireland remained in the single market to avoid a return to a rigid border with the Republic of Dublin to the south, since London will be out of the single market and customs union by the end of this year.

Even the British minister for Northern Ireland candidly admitted to MEPs that the law is a violation of international law, given that that agreement between London and Brussels has a formal treaty value. But Johnson no longer intends to accept the prospect of effectively seeing Northern Ireland separate from the rest of Britain: and therefore he has decided to renounce the Treaty. The Brussels counter-move it represents an unprecedented escalation, as the negotiation to conclude is approaching its final stages an understanding that governs post-Brexit mutual relations.

At this point the possibility that everything will jump is very concrete: in this way at the end of December we would go to a no deal, a Brexit without agreements that would see the return to duties and customs, with heavy economic consequences for everyone, including Italy. London has seriously damaged trust between the European Union and the UK, the Brussels Commission said flatly.

But Downing Street has already made it known that it has no intention of backing down: in a written legal opinion, the British government admits that the law may be incompatible with the provisions of the Withdrawal Agreement, but at the same time claims that Parliament sovereign and can pass laws that violate the obligations of the signed Treaties. A statement that has left Europeans baffled to say the least. Even within the Conservative Party, perplexities are growing about the kamikaze line adopted by Boris: Three former leaders of the Tories (Lord Howard, John Major and Theresa May) have publicly criticized the decision to renounce past commitments: who trusts more to make deals with Great Britain – they wondered – and how will London be able to stand up as a judge of tyrannies like the Russian, Chinese or Iranian when the first to violate international law?

Many wonder why Boris took this path: e there are those who suspect that this is a provocation to force Brussels to abandon the ongoing negotiations on post-Brexit structures. Indeed, the Brussels ultimatum represents an unprecedented escalation, as the negotiations to conclude an agreement to regulate reciprocal trade relations after the end of the transition period, on 31 December, are starting to finalize.

At this point the possibility that everything will skip is very concrete: in this way, at the end of the year there would be a no deal, a Brexit without agreements that would see the return to duties and customs, with heavy economic consequences for everyone, including Italy (our commercial exchange amounts to 30 billion). But perhaps the price that Boris has chosen to pay to guarantee a total free hand to his Global Britain.
