Banks began to forcibly write off the debts of Ukrainians: who will fall under the gun

Banks began to automatically write off the debts of Ukrainians at the request of state and private executors. This applies to those citizens who are included in Unified register of debtors.

According to information The Opponent, now in such a Register there are 5.5 million debts. Most of them are debts to public utilities, fines for violation of traffic rules or non-payment of alimony.

Already connected to the automatic write-off system 7 banks… These include Taskcombank, PrivatBank, Universal Bank (monobank), OXI Bank, Bank Vostok, Industrialbank, ProCredit Bank.

In test mode, 44 financial institutions are currently connected to this system. This means that they have given prior consent to join. The Ministry of Justice says that in general, 62 out of 73 banks support this model of work. It should be noted that banks are connected to the automated system voluntarily… The law does not oblige them to interact with the performers electronically.

Recall that on April 6, an order of the Ministry of Justice came into force, according to which money from the accounts of debtors will be charged automatically. Previously, executors and banks could enforce only funds for non-payment of alimony. In other cases, banks blocked accounts, but a separate paper request was required to collect funds.

In addition, the issue of bank secrecy arose earlier. According to the law, the bank is obliged to disclose it to the contractor, however, it often did this in the form of providing general information about the presence or absence of an account. However, on February 12, the National Bank introduced changes to their rules – now banks are obliged, at the request of the contractor, to provide information about the details of the debtor’s accounts and the amount of funds for them.

Thus, to date, the procedure for automatically collecting funds from debtors’ accounts takes place in a few clicks online and looks something like this:

  • the executor, using an automated system, creates a request to obtain information about the availability of the debtor’s accounts and funds for them;

  • all claims from executors are uploaded to the information systems of banks, which check whether they have debtor accounts;

  • if there are accounts, the bank’s system no later than one hour transmits to the contractor information about these accounts and the amounts on them;

  • the executor forms a resolution on the seizure of funds in the system, after which the person in charge of the bank executes such a decision.
