Prague Prime Minister Andrej Babiš (YES) did not rule out the possibility that a state of emergency could be declared again in the Czech Republic due to coronavirus. This would be the case if the Ministry of Health needed to declare some measure that it does not have competence under the Public Health Protection Act. The proposal would have to come from the Minister of Health Adam Vojtěch (for YES), Babiš told reporters on Friday.

So that it does not happen that any measure he takes will be in conflict with them, “said Babiš.

The Prime Minister added that Vojtěch should come up with a government proposal for a government meeting on Monday. “We will find out from the minister on Monday. If he proposes some measures that would exceed his competences within the framework of the Act on the Protection of Public Health, then this (state of emergency) cannot be ruled out, “Babiš admitted.

At the same time, the Prime Minister stated that he had no signals that in connection with the significant increase in those infected, there would be a problem with the organization of regional and senate elections, which are to take place in two weeks. He reminded that the organization of the elections is in charge of the Ministry of the Interior Jan Hamáček (CSSD). “I have no signal from Mr. Hamáček that changes are being considered,” he said.

He added that some people who sit on election commissions are afraid, but this is addressed by the relevant municipalities and cities. Due to the assumption that some voters will be quarantined at the time of voting, the Chamber of Deputies has adopted a special law on holidays that will allow voting from the car or in special constituencies.

In April, the Prague City Court annulled four measures taken by the Ministry of Health to restrict free movement and retail in connection with the coronavirus pandemic. According to the verdict, they are illegal because the government did not adopt them under the crisis law. The cabinet then preferred the crisis measures, which it approved as a whole, but in May it had to transfer the remaining measures to the regime of the regulation on the protection of public health, because it would expire at the end of the state of emergency.

As a result, the government decided in May to extend the powers of the Ministry of Health by a special law, which it planned to take effect by the end of this year. The amendment was to explicitly give the ministry the power to regulate, for example, trade, services and production facilities, swimming pools and any public and private events, nationwide. However, the draft is still in the Chamber only before the initial round of deliberations.
