Axel Kicillof removed the sanctions against teachers who made stoppages during the government of María Eugenia Vidal

The Buenosairean government left on Thursday the disciplinary administrative summaries initiated to teachers in the province of Buenos Aires who carried out different measures of force during the administration of María Eugenia Vidal.

The sanctions had been applied against teachers for “failing to carry out the functions inherent to the position with dignity, efficiency and responsibility, for failing to complete the opening and closing of the school building” during different work stoppages carried out in 2018.

In addition, in the measure, which was published in the Official Gazette with the signature of the Director of Culture and Education, Agustina Vila, and the undersecretary, Claudia Bracchi, it was decided to “absolve” the teachers who are still under investigation and to those who failed to prove the transgression of an administrative offense.

At the same time, the instruction of administrative summaries made to the directors for “not supervising and subscribing the teaching and administrative control forms, in which the absences of the institution’s personnel, corresponding to the days of unemployment, were closed.”

It was also highlighted that “the assumed teaching behavior is contextualized within a collective conflict, the facts described acquiring an institutional dimension that takes on its true meaning by articulating the individual and social rights involved”.

During the previous government, the guilds Federation of Buenos Aires Educators (FEB), the Association of Teaching of Technical Education (AMET), the Unified Union of Education Workers of Buenos Aires (SUTEBA) and the Union of Teachers of the Province of Buenos Aires (UDOCBA) they questioned the summaries initiated against teachers when they considered that they constituted a “union persecution“.

In fact, they filed a union protection lawsuit against the Ministry of Education that it processed in the Labor Court No. 3 of the city of La Plata, claiming that the state body exercised a consistent anti-union behavior in hindering the regular exercise of the right to strike of teaching workers.

On December 21, 2018, in that case, the General Directorate of Culture and Education of the Province of Buenos Aires was ordered to cancel the disciplinary administrative summaries, initiated against the directors for not opening the educational buildings during the days of unemployment and the February 14, 2019 the Court expanded the precautionary measure in the same sense.
