The Arnhemmer who drove to death in 2017 an armed man who had robbed him, is not punished. The court of Arnhem fires the man of prosecution on Wednesday because the emotions of the Albert K. were so “intense and intense that he could not think reasonably”.
On March 30, the family had an appointment with a man who wanted to buy an expensive watch that had been offered on Marktplaats just before.
However, it turned out to be a robber who shot through the front door and into the house. K. fled outside with his girlfriend. There they encountered a passing meal delivery boy in a van. The pair jumped on the bus after the delivery guy fled when they heard the couple’s screams.
When the robber opened fire again outside, K. ran into him twice. The robber died on the spot.
The court says that it took only two minutes between the shooting in the house and the second collision. K. panicked completely and therefore had no control, according to the judges. “From this condition he hit and robbed the robber.”
The Public Prosecution previously wanted no punishment to be imposed
Because the man has been released from prosecution, he also does not have to pay damages to the survivors of the robber.
The Public Prosecution Service (OM) previously argued that K. acted out of panic in the first collision and can therefore appeal to severe weather. The court therefore agrees.
Because these are exceptional circumstances, the Public Prosecution Service wanted to bring the case to court.
