The consumer organization dTest has therefore prepared some advice on what people should look out for when choosing a holiday and what their rights are.
One of the first worries of tourists who arrange a holiday on their own is choose and get accommodation. The contract can be concluded very easily. Currently, for example, by phone or via e-mail reservation.
“Unlike other distance services, however, it is not possible to withdraw from the contract within 14 days without giving a reason without penalty. The accommodation contract is an exception to this option and if you respond to the online offer, the contract will become binding as soon as your reply landlords, ”warns Eduarda Hekšová, director of the consumer organization dTest.
However, it is important to know that accommodation can of course be canceled. The law allows the contract to be terminated at any time before the start or also during the stay. However, if the owner of the accommodation does not find a new applicant, the person who has booked the accommodation must compensate for any damage.
If there is more than half a year left before the start of the stay, no damage is likely to occur. However, people will probably pay for the accommodation in full when they decide to cancel it the day before. It is therefore important to pay increased attention to the terms of the contract.
The landlord is obliged to hand over the rented premises so that it is possible to use them undisturbed. At the same time the quality must correspond to the previous agreement.
“If you have been attracted to photos of beautiful rooms with bathroom and view, such information as part of the offer is binding for the landlord,” Hekšová emphasizes. the owner of the accommodation will not arrange a remedy.
In addition, most people have no idea that if you ask the landlord, they must take over and store your valuables and money. He is then responsible for these things, so there is no need to worry about them.
It is possible to enjoy the summer holidays also rent a cottage or summer apartment. As it is not a contract that provides permanent housing, it is subject to less stringent rules. For example, it does not necessarily have to be in writing.
Unless the interested parties agree otherwise with the landlord, he must carry out routine maintenance and take care of the property. Repairs beyond the normal range must be carried out by the landlord. However, if he does not do so, the tenant can remove the defects himself and then deduct the price from the rent. At the moment when the defects are fundamental and make it difficult to use the entire building, the tenant has the right to waive the lease, or to terminate the contract without notice.
We can choose the place where you will spend your summer vacation in the Czech Republic yourself, or if you are interested, use the services of travel agencies or agencies and choose from their offer. If you go on holiday but by your own car, you do not enter into a travel contract with a travel agency.
“In order for a tour to be a tour in the legal sense, it must contain at least two tourism services, ie transport and accommodation or guide services and the like,” says Hekšová.
It will not be a trip even when people find accommodation in front of intermediary serverssuch as booking.com. In this case, the contract is concluded directly with the accommodation facility, to which the server only referred. In addition, this intermediary must, by law, ensure that the contract is concluded with a trustworthy person.
If these obligations are neglected, people can claim damages from the intermediary. It pays to be careful when concluding a contract.
