Amnesty Law published in Official Gazette; takes effect on Thursday

The Presidency of the Republic and the Ministry of the Interior published in the evening edition of Official Journal of the Federation (DOF) a decree by which the Amnesty Law, with which the government will release people who did not commit serious crimes and remove from prison vulnerable sectors in the face of the coronavirus pandemic (Covid-19).

The decree, which comes into force tomorrow, explains that the amnesty will benefit those accused of abortion, kinship murder, crimes against health, sedition, and simple and non-violent robbery.

For each crime, details are made about the circumstances that will allow the accused to be released, for example, in the case of crimes against health, it is explained that only those who committed this crime will be benefited because they are in a situation of poverty or extreme vulnerability; for having a permanent disability; when the crime has been committed by indication of the spouse, among other factors.

The decree informs that in the case of those sentenced, the actions leading to order their release will be carried out, while in the case of people subject to process or even fugitives, the Attorney General of the Republic will be ordered to withdraw the action. penal.

For its part, the Federal Executive has 60 working days to form a Commission that will coordinate the acts to comply with and monitor the application of the Law. Meanwhile, within the same term, the Federal Judicial Council must determine the competent federal judges that They will know about amnesty.

The interested person, their legal representative, relatives in a kinship relationship by consanguinity or affinity of up to four degrees, and public bodies defending human rights may request the special Commission to apply this Law. The request will be resolved within a maximum period of four months counted from the presentation of the same.

In the fifth transitory of the Law it is indicated that within 180 days after its entry into force, the Congress of the Union will review the crimes that benefit from the amnesty to assess the validity of its configuration elements.
