Two, it is not clear whether all Republicans will rush to appoint a Chief Justice. Lisa Murkowski from Alaska and Susan Collins from Maine think that this is no longer possible until November. Collins had previously ruled out that a “lame duck Senate” – a retiring Senate after the election – would be allowed to appoint a Chief Justice. The newly elected Senate will take office in early January.
