On Monday, the Hamburg public prosecutor announced that they were bringing charges against HSV professional Bakery Jatta. The message states: “The accused is accused of violating the Residence Act in four cases and of indirect false certification in another case.”

According to the authorities, Jatta is actually called Bakary Daffeh and given an incorrect date of birth.

He came to Germany in the summer of 2015 as a refugee without a passport or residence permit and pretended to be 17. He fell into the category of “unaccompanied minors in Germany” – and was allowed to stay.

That’s why he now has to answer in court. But what consequences does Jatta have to expect now?

Jail sentence for Jatta?

A court spokesman from Hamburg told the “Bild” newspaper: “According to adult criminal law, a sentence of up to three years in prison or a fine would be threatened.”

In the case of Jatta, however, juvenile criminal law will probably apply, as he falls into the “adolescent” classification. The court spokesman: “The judgment is a matter of discretion for the presiding judge.”

Attorney Markus Mingers told “Bild”: “In case of doubt, Jatta will be sentenced according to juvenile criminal law. The focus here is on the idea of ​​upbringing, so that the penalties are much milder than in adult criminal law.”

According to Mingers, this could be “social hours or attending educational seminars”. The lawyer, however, does not believe that Jatta has to go to jail.
