Adam Deni Sentenced to 4 Years in Prison Case of Illegal Access to Sahroni’s Documents

Social media activist Adam Deni Gearaka and his colleague, Ni Made Dwita, were each sentenced to 4 years in prison in the case of illegal access to confidential documents belonging to DPR member Ahmad Sahroni.

The Panel of Judges of the North Jakarta District Court (PN Jakut) stated that Adam Deni and Ni Made were legally and convincingly proven to have uploaded other people’s confidential electronic documents which resulted in the disclosure of confidential information being accessible to the public with improper data integrity.

“Therefore, defendant 1 Adam Deni and defendant 2 Ni Made were sentenced to 4 years in prison,” said Chief Justice of the Jakut District Court Rudi Kindarto, Tuesday (28/6).

The judge also imposed a fine of Rp. 1 billion each, if not paid, replaced by imprisonment for 5 months.

Adam Deni and Ni Made were proven to have violated Article 48 paragraph (3) in conjunction with Article 32 paragraph (3) of Law (UU) Number 11 of 2008 as amended and added to Law Number 19 of 2016 concerning Information and Electronic Transactions (ITE) in conjunction with Article 55 Paragraph (1) 1st of the Criminal Code.

Previously, the Public Prosecutor (JPU) demanded that Adam Deni and Ni Made be found guilty of illegally accessing Ahmad Sahroni’s documents as the first indictment.

The prosecutor asked the Judges of the Jakut District Court to sentence Adam Deni and Ni Made to 8 years in prison and a fine of Rp. 1 billion, subsidiary to 5 months in prison.

Adam Deni and Ni Made were previously charged with violating Article 48 Paragraph (3) in conjunction with Article 32 Paragraph (3) Law (UU) Number 11 of 2008 as amended and supplemented by Law Number 19 of 2016 concerning Information and Electronic Transactions (ITE) in conjunction with Article 55 Paragraph (1) of the 1st Criminal Code.

Then the indictment of the subsidiary is Article 48 paragraph 1 in conjunction with Article 32 of the ITE Law in conjunction with Article 55 paragraph (1) of the Criminal Code.
