A letter changed position has brought Rosi Cuevas Lavado, a neighbor of Talavera la Real, to whom the Treasury has seized her car for not paying the fine of 1,500 euros that the Local Police agents put on her head for two and a half years for not having your car insured.

That sanction was imposed on him on August 13, 2018 when he was returning to Talavera aboard his Peugeot 407. He was going up the BA-20 from the Seville road junction when a couple of motorcyclists caught up with him. “They told me that they had detected that I did not have the insurance in force and that I could not continue driving. I was surprised, because I had the policy paid, but when I showed it to them they told me that it did not correspond to the license plate of my car “, recalls the victim. At that moment he verified that what they said was true. One of the letters on the license plate (DCV but in the insurance they put DVC) had danced and the car actually insured was not his. “You have been lucky, if you had an accident the problem would be serious,” they told him.

At that moment their car was taken and Rosi called the agent with whom she had signed the insurance to inform her of what happened. But he did not find her and went to the office that Generali has on Avenida María Auxiliadora in Badajoz.

There they confirmed that the license plate included in the policy was wrong and they gave him a document warning of this circumstance so that he could deliver it to Traffic.

The next day Rosi already had the new policy and soon got the car back. But some time later he received the traffic fine: 1,500 euros for driving without insurance. «I called Madrid and they indicated the documentation that I had to send. I went to Traffic, I sent emails, I received emails, I received whatsapps and I thought that everything would be solved ».

But some time later they sent him a letter stating that he was running out of administrative processes.

Then he received a new fine that already exceeded 1,800 euros for not having paid on time. “At that moment I contacted the insurance company and a person in charge came with me to Traffic to try to show that the problem was in a dance of letters, that I was insured. But the time to complain ran out and they told me that I could no longer do anything except if I went to court ».

At that point, the penalty already amounted to 1,847.72 euros and as the days went by he received a communication from the Treasury indicating that due to non-payment they were going to seize his current car, a Citroën Scenic. “I contacted the insurance company again and they told me that they could not do anything and that they were not going to continue with this process.”

Desperate, Rosi contacted a lawyer to go to court. But before, despite being unemployed, he negotiated with the Treasury a payment letter to divide the fine and begin to pay 150 euros per month to cover the total debt. “The other alternative was the embargo,” he says.

“At that time they even told me that it was my fault, that I had to have paid the fine and then claimed the money, that I was the one who had exhausted the administrative deadlines and they were not going to take care of anything.”

Overwhelmed, she decided to head to TODAY to expose her problem. “I feel totally unprotected, I was driving with all the confidence in the world because I thought the insurance was correct. What was I paying for then? The Local Police told me that I should thank them for stopping me: if you have a serious accident, I put the handcuffs on you and automatically take you to jail, “they told me that day.

After hearing his story, TODAY contacted the Generali office in Badajoz on Thursday to find out the reasons why the company had not taken over the payment of the fine. Twenty-four hours later, Rosi received a call from that same office to announce, now yes, that the company will assume the fine and also the surcharge.

From Generali it has been confirmed TODAY that the payment of the money will be made shortly. In addition, the company regrets that the delay in payment has occurred and that this has caused uneasiness for this insured.

“I trust that everything will be solved, but I believe that these things should be solved in a simpler way when the error is not the client”, Rosi sums up now that they finally seem to agree with him.
