Veselina Gineva, 67, from Burgas, will spend the next 17 years of her life behind bars. The primary school teacher was convicted of the murder of her ex-husband Dimitar Mirazchiev, whom she held captive for 6 months only on bread and water. After his death she hid the corpse and for 2 years took his pension.

A few days ago, the Supreme Court of Cassation confirmed the sentence, the decision is final and not subject to appeal. However, the Supreme Magistrates acquitted the defendant of one count of the accusation – that she did not commit the murder for personal gain, because she was

took the pension

of Dimitar and while

he was alive

with a power of attorney signed by him. When Veselina took care of him, he was already suffering from severe alcoholism and had difficulty coping on his own.

Despite the partial acquittal, however, the magistrates did not reduce the sentence of the teacher, who earned the nickname The Black Widow. According to the Supreme Court of Cassation, the abolition of the qualification “murder for profit” does not significantly affect the degree of public danger of the act, which remains extremely high.

The case reached the Supreme Court on an appeal by the defendant, who challenged the decision of the Burgas Court of Appeal. It confirms the ruling of the court of first instance. Burgas district magistrates found Veselina Gineva guilty of three charges.

One is that from May 2013 to August 1, 2014 in her home in Lazur residential area Veselina Gineva illegally imprisoned her ex-husband Dimitar Mirazchiev, keeping him locked in one of the rooms of the apartment. For this, the court sentenced her to 6 years in prison.

The second charge is for the murder of the former engineer from “Neftochim”, which according to the Burgas magistrates was committed for selfish purposes and in a particularly painful way for the victim.

The 65-year-old Mirazchiev was kept locked in a room with nailed windows,

systemically

malnourished,

without the necessary

drugs and

medical assistance

He died on August 1, 2014 after several months in captivity in his former apartment, which remained with Veselina after the divorce. The Black Widow was sentenced to 17 years in prison for this act.

The third accusation is that during the period from Mirazchiev’s death to August 31, 2016, Gineva withdrew his pension from a bank 28 times, claiming that Dimitar was alive. Thus, she damaged the state budget by over BGN 20,000, for which the court imposed 3 years and 6 months in prison.

When she found out that the sentence remained the same in the last resort, the resident of Sliven Prison was shocked. “My client is devastated. She believed and hoped her sentence would be reduced. My expectations were that the case would be remanded to the Court of Appeal for substantial violations. I am surprised that despite Gineva’s acquittal on one of the qualifying circumstances – namely that she did not commit murder for profit, the court did not reduce, albeit minimally, the sentence, as is the usual practice in such cases, “said lawyer Veselina Vasileva. who represented Gineva in court.

The defense’s thesis is the lack of evidence that Gineva caused the death of her ex-husband with her behavior.

However, the Supreme Magistrates have a different opinion. They remind that it has been clarified by an expert that the diseases that existed under Dimitar Mirazchiev could not have led to a lethal outcome. Immediately before his placement with the defendant, his general health was satisfactory. One year later, the elderly man was already severely emaciated, his body weight was reduced by 50%.

The experts pointed out that the reasons for this were chronic malnutrition and dehydration for months, and the deterioration had progressed to a state of cachexia, ie. extreme exhaustion, predetermined the lethal outcome.

According to the Supreme Court of Cassation, the Court of Appeal in Burgas gave a correct answer to the defense’s objection that the defendant had no legal obligation to take care of her ex-husband, but by taking care of him on her own initiative, she was obliged to provide him with a normal life.

From the very beginning until the end of the trial, the former primary school teacher pleaded not guilty. At one of the first court hearings, she fervently stated: “My nature is altruistic, I am ready to give my life for the greatest alcoholic. And he carries a soul. I hid this from people, but

he was full

alcoholic.

He reached out to me

and my daughter

One time he smashed my head with a frying pan, but I didn’t even go to the doctor. My whole conscious life has been focused on teaching, protecting and educating young children from 1st to 4th grade. If I have a brutal tendency to torture, they would immediately manifest themselves in my work with children and parents. They would signal in any way. “

However, evidence has been gathered in the case that the tortured Dimitar asked for a locksmith to be called to release him, he signaled to the neighbors that he needed help by throwing notes through the windows. In such a case, Vesselina understands and nails the windows of the room, investigators reveal.

On March 10, 2014, a note came to a neighbor who called the police. Initially, Veselina does not open, and then locks herself in the bathroom with Dimitar. Police and firefighters are shocked by his appearance. Dimitar

weighed no more

from 45-50 kg,

beard

After the police took the emaciated engineer out, he spent some time in hospital and then returned to his apartment in the Slaveykov complex. Only a few days later, however, Veselina took him back to the Lazur residential area, ostensibly to take care of him, because the former boss of Neftochim suffers from alcoholism and a bunch of other chronic diseases. And the captivity continues. Until August 1, when Veselina heard her ex-husband’s heavy, wheezing breathing, but never called an ambulance.

Dimitar dies, and that same evening Vesselina stuffs the skinny body into a garbage container on wheels, which she had previously found and put in her apartment on the 8th floor. In the dark

dump the container

with the corpse and pushes it

about 2 km to the bridge

in the Sea Garden. At first she thinks of throwing the body into the sea, but she gives up and picks up her husband’s corpse again, tucked into the moving cauldron. It passes through the entire Sea Garden and leaves the container near the railway crossing near the College of Tourism.

For Veselina, the story does not end here. The black widow regularly goes to the place to check if the body is there. Until one day he heard on television that

in this area

are found

human remains

This happened on February 26, 2015, when cleaning workers came across the ominous find. The human remains are in the bushes about 10 meters from the rails.

Pathologists did not find visible traces of violence, but managed to extract a DNA profile from the femur. A comparative analysis was made with profiles of missing persons wanted, but there was no match, forensic scientists recall.

It was not until June of the following year that a breakthrough in the investigation took place and the case began to unravel. A crucial role is played by an anonymous signal that reaches the police. This is a letter from an unknown author, which revealed details of the engineer’s death, including how after his death Veselina put the body in a container and left it in the Sea Garden.

Forensic scientists were impressed that the letter contained facts that completely coincided with the find from the railway crossing, although a container was never found. According to one version, the letter was written by Veselina’s neighbor, who overheard a conversation between her and a close friend. In it, the teacher told how she got rid of the body and boasted that she continued to receive Dimitar’s pension of BGN 910. Vesselina was placed under police surveillance, and forensic scientists studied her daily routes, behavior and habits.

The identity of the found human remains was identified only in the summer of 2016 through the daughter Vanya Mirazchieva, from whom forensic scientists took DNA. In June 2016, she declared her father wanted after trying unsuccessfully to find out where he was. For almost two years, her mother

she lied that Dimitar

is accommodated in a home

for elderly people outside Burgas.

Veselina Gineva was arrested at the end of August 2016, and the trial against her began a year later.

“It simply came to my notice then that she was not behaving adequately. While she was in prison awaiting sentencing, there were reports of her mental condition. She was in the prison hospital in Lovech for more than a month. But when during the trial I asked for an expert to be appointed to establish whether at that moment she could adequately participate in the process, I was denied, “commented lawyer Vasileva.

The last widow of the Black Widow from Burgas is early parole, which can only happen after serving more than half of her sentence and behaving well in prison.
