Josep Asensio Serqueda, lawyer and ex-agent of the Mossos d’Esquadra, was the one who promoted with his appeal as a private individual that the justice, the administrative contentious chamber of the Superior Court of Justice of Catalonia (TSJC), overthrew the decree of the Government yesterday that suspended the convocation of the parliamentary elections scheduled for February 14 to estimate the very precautionary measures requested.
The lawyer signs the first challenge that the Catalan high court asked for the precautionary measures, an initiative to which the Left in Positivo party joined a day later, led by former Podemos senator and lawyer Celia Cánovas, who drafted the appeal of the extra-parliamentary force .
Asensio was in the Generalitat police force for 21 years, where he was a representative of the workers, minority groups, and was punished with four months of suspension of employment and salary for defending a colleague filed by the Department of Interior in 1999. But in May 2001, a ruling by the TSJC agreed with him and annulled his sanction, considering that when he defended the other uniformed man, he was not on duty and that he was acting as a citizen.
He has a degree in Law from the UNED and in Hispanic Philology, and resides in Maresme. Now he studies Telecommunications Engineering and considers himself a “police lawyer”, as he himself said yesterday in RAC1. He assures that he began studying the career when he was still an agent of the Mossos to face the corruption of 3% of Convergència and to defend himself against the files because the unions “did not have the capacity to do so.” “I used my only asset, which is the ability to assimilate information and study,” he explained yesterday.
In addition, he was the first lawyer, in May 2019, to arrive in Strasbourg with the dismissal of Carles Puigdemont as president of the Generaliat through the application of article 155 by the Government of the PP.
In 2017 the Catalan National Assembly raised funds for him with its solidarity fund, for a complaint for prevarication that he filed against the then judge of the National Court Carmen Lamela and now from the Supreme Court, which sent the independence prisoners to preventive detention. However, it was shelved.
In 2014 he presented a Amparo appeal in the Constitutional Court with his sister Marta for the suspension of the consultation that Artur Mas called for 9-N with the intention of reaching the European Court of Human Rights (ECHR). On the other hand, among other causes in which he has been a protagonist, he appeared as a popular accusation against the Pujols that same year, after the former president’s confession, although he ended up giving up.
According to the Efe agency, in 2001, when he was still acting as mosso, a complaint was filed against the former general director of Citizen Security of the Generalitat Xavier Martorell for issuing instructions that affected the internal functioning of the regional police, although the case was archived.
Former colleagues of his from the body consulted by this means affirm that he has been on leave for many years, that he was “critical” of the police leadership and that he is pro-independence, but that he was not linked to any party.
Asensio himself explained yesterday on the Catalan station that behind him “there is no one” and that he does not act at the request of any formation. Likewise, he pointed out that the decree of the Catalan Executive to suspend and postpone the regional elections has no basis, is not legal and that the person who signed it, Vice President Pere Aragonès, has no powers. And he warned of the “power vacuum” that leaving the Parliament in limbo for half a year in a pandemic context can cause.
