A lawyer sentenced to a year and a half in jail for defrauding a client in a foreclosure case

  • The lawyer appropriated several amounts collected from the affected person to negotiate the dation in payment of his home

The Alicante Provincial Court has sentenced a lawyer to a year and a half in prison for defrauding a client in a foreclosure case. Thus a case that was instructed by Court number 3 of Dénia is resolved.

The judgment considers it proven that the lawyer collected various amounts from a client to negotiate a dation in payment with the bank to which he owed amounts of the mortgage on his home. Amounts that the defendant misappropriated and did not deliver to the bank.

The Court now condemns the lawyer, a native of Alicante, to one year and six months in prison for a crime of aggravated fraud, and also imposes a seven-month fine at the rate of 6 euros per day. Asismo, he is disqualified from practicing the legal profession during the time of the sentence and must compensate the client with 13,950 euros plus interest.
