A lawyer convicted of conspiracy with an insolvency judge failed at the Constitutional Court

Zvoníček was given a year of imprisonment with a conditional suspension for two years and a ban on independent law practice for 2.5 years for instructions on abuse of power. He offered Judge Kozák to try to include a claim for almost half a million crowns in an insolvency case led by another judge, even though the deadline for filing claims had expired.

The judge then actually tried to push the application through the registry to the file and claimed that he had found the document in his file by mistake. However, the registry refused to accommodate the judge, so he tried to do the same with another clerk in the court office. But he didn’t walk there either. Kozák had to leave the judiciary after his conviction, his complaint had previously been rejected by the Constitutional Court.

He failed to defend himself

In his complaint, Zvoníček tried to argue that his defense was actually prevented by the fact that he was to commit an act while practicing law, and thus he was bound by a duty of confidentiality in relation to his client. However, the Senate of the Constitutional Court and Judge-Rapporteur Jaroslav Fenyk refused to proceed with such a defense.

The judges pointed out that even in such cases, a lawyer can defend himself. “However, he must observe the legitimate interests of his client and be exempted from the duty of confidentiality only to the extent necessary for his effective defense. The complainant did not even attempt to exercise his right to a defense in this way, “stated the Constitutional Court and rejected the complaint.
