EMRA Updates Regulations for⁣ Unlicensed Electricity Generation

the Energy Market Regulatory Authority (EMRA) has implemented new​ regulations concerning the​ transfer and connection​ of unlicensed electricity generation facilities, ​as published in the Official Gazette.⁢ These amendments to the Unlicensed Electricity Generation ⁣regulation impact ‌how facilities‌ can⁣ be transferred and connected to the electricity grid.

Generally, facilities subject‌ to transfer (excluding cases of inheritance or‍ bankruptcy) ⁣are prohibited from re-applying ‌for a new consumption facility association. Any connection ‍agreement requests for a‍ new consumption facility ⁤linked to ⁢a transferred generation‌ facility will not be evaluated,unless the production facility and its ⁢associated consumption facility are transferred ⁣to the same entity,or between public⁣ institutions.

Transfers occurring within the same month must be reported to the market operator by the 15th of⁢ that month,who will then inform the relevant network operators.

For⁢ wind ‌and solar ‍energy facilities, connection priority​ will be ⁢determined based on several factors ⁤when ⁢a call ⁤letter hasn’t previously been issued.⁤ these ⁣factors, in order⁣ of ‌importance, ‍are: high ‍annual consumption, strong contract terms, and a ‍lack of‍ prior positive connection opinion.

Changes to a consumption facility must maintain or increase capacity. The contract power and annual consumption ⁤of any new facility ‍must ​be⁣ equal to or greater than the current production capacity. If ​these requirements aren’t met, excess energy generated will ‍not be ⁣compensated⁣ and will instead be considered a voluntary contribution ⁣to the ⁣Renewable Energy Resources ​Support Mechanism (YEKDEM).

When evaluating new applications, previously allocated production capacity for the‌ same consumption facility will be deducted ​from the current⁤ request. Furthermore, excess energy ‌can be sold through energy‍ aggregators. The market operator will implement a‌ system, effective December 15th, to track data related to these transfers and connection priority⁣ evaluations.
