CINEPLEX Competition Rules & Regulations – Summary
These rules outline the conditions for participation in CINEPLEX competitions.
1. Participation & Prizes
* Entry Method: All entries must be submitted through the online competition form on the CINEPLEX website. Postal entries are not accepted.
* Individual Participation: Each person may only enter the competition once,in their own name. Transferring entries to others is prohibited.
* Winner Notification & Prize Details: Winners will be contacted via written notification or email. CINEPLEX reserves the right to publish winners’ names on its website. Prizes cannot be exchanged for cash,and there is no legal recourse regarding prize awards.
2. Data Protection & Processing
* Data Collection: CINEPLEX collects participant data to manage the competition, storing it electronically and adhering to German Federal Data Protection Act and Telemedia Act regulations. The Facelift system (Facelift brand buildings technologies GmbH) is often used for data recording and winner selection, with CINEPLEX remaining responsible for data processing.
* Data Sharing: Winner’s personal data might potentially be shared with partners necessary for prize delivery or claim.
* Marketing Use: Participant data will not be used for advertising, market research, or opinion research without explicit consent.Data will only be used to send cinema-related data or updates affecting future contracts (like changes to competition rules) with the participant’s express permission.
* Data Access: Participants have the right to request information about the data CINEPLEX holds about them. Inquiries shoudl be directed to [email protected].
* Publication of Winner Details: By entering, participants authorize CINEPLEX to publish their name and place of residence on the CINEPLEX website if they win. winners will be notified by email or letter, which participants agree to receive by entering the competition.
* Social Media Participation: Competitions may be accessible via Facebook and Instagram. Participation through these platforms involves data transfer (name, email, profile picture, address, answers, photos) from the user’s account after login and confirmation. * Data Usage Declaration (DNE): CINEPLEX’s Data Usage Declaration (DNE) also applies.
3. General Legal Information
* Governing Law: German law applies to all business relationships with participants, excluding the UN Convention on Contracts for the International Sale of Goods.
* Severability Clause: If any provision of these rules is deemed invalid, the remaining provisions remain in effect.Invalid provisions will be replaced with standard industry practice or, if none exists, by applicable statutory provisions.
