Five years after the implementation of the rental framework in Paris, Consumption Housing Framework of Life announces in a press release on Tuesday, January 26 that it has noted 40% of non-compliant advertisements. The consumer association notes that the measure is better respected by real estate agencies than by individuals, with respectively 75% and 50% compliance rate.

It’s time for professionals to fully assume the consequences of their actions“, can we read in the press release.”They are ethically bound to respect the law and protect the interests of both the lessor and the tenant.

An excess of € 1,500 per year paid by the tenant

On average, the association estimates that 1.500€ are supported every yearin all illegality“by tenants”because of donors or unscrupulous professionals“. CLCV gives the example of a two-room apartment”for a rent of € 1,270, while it should be € 900, i.e. a surplus of € 4,400 per year“.

“Faced with this observation, the CLCV asks the Prefect of Paris to systematically apply the administrative fine for each non-compliant ad. If the first sanctions have started to fall, they are still too rare. On this point, we can only support the system which the Paris town hall wishes to acquire in order to strengthen the controls of advertisements “, adds the consumer association.

The CLCV nevertheless underlines theeffectiveness of rent control, who “helps maintain the middle classes in urban centers“. The association also notes”with satisfaction that several municipalities have requested the application of this device on their territory“.

“We regret, however, that the mayors of Marseille, Toulouse or Strasbourg have not come forward.”

We are still a long way from the 1,151 cities potentially affected by rent control“, develops CLCV. “This is why we are setting up the site www.monloyertropcher.org in order to allow everyone to approach their local elected officials on this issue. “

Century 21 France sued

The Consumption Housing Framework of Life consumer association (CLCV) takes Century 21 France to courtfor deceptive marketing practices“, “thus making the CLCV the first consumer association to bring an action in terms of rent control against a national group. “

On the ten websites consulted for the conduct of the study, the compliance rates vary between 27% (Released Sold) and 93% (Funcia). At the top of the ranking are three sites belonging to professionals (Foncia, Attoun and Orpi). “Results in line with what we have been observing for years, namely a much better respect of rent control by real estate agencies than by individuals“, analyzed the association. Despite this, and still according to this study, only 66% and 67% of Century 21 and some FNAIM are compliant, i.e. a gap of 27 points with Foncia.

Real estate agents are required to ensure the protection of the interests of each of the parties to the contract, the lessor and the tenant. The assignment of Century 21 France by the CLCV goes precisely in this direction and joins the desire of the Minister, Emmanuelle Wargon, that professionals no longer market goods whose rent is greater than the legal maximum.“, develops the CLCV.
