23XI Racing, Front Row Motorsports Respond to NASCAR Summary Judgement Motion
CONCORD, NC – October 11, 2024 – 23XI Racing and Front Row Motorsports have filed responses to NASCAR’s motion for summary judgement in the ongoing dispute regarding the Next Gen car’s parts system, according to court documents filed today in the U.S. District Court for the Western District of North Carolina. The teams are challenging NASCAR’s control over the sourcing and supply of single-source components for the current generation of race cars.
The legal battle centers on NASCAR’s decision to mandate specific vendors for key parts, a move 23XI and Front Row argue stifles competition and drives up costs. A ruling in NASCAR’s favor woudl solidify its authority over the parts supply chain, while a favorable outcome for the teams could open the door for greater vendor choice and potentially lower expenses. The case impacts all NASCAR Cup Series teams, wiht the outcome potentially reshaping the economic landscape of the sport.
NASCAR initially filed suit against 23XI and Front Row in July 2024, seeking a declaratory judgement upholding its right to control the parts supply. The teams countersued, alleging anti-competitive practices and seeking to invalidate the single-source requirements.
According to court filings, 23XI’s response asserts that NASCAR’s actions constitute a restraint of trade, hindering the teams’ ability to negotiate favorable pricing and secure quality components. Front Row Motorsports echoed these concerns, arguing that the limited vendor options create a dependency that disadvantages smaller teams.
“We believe NASCAR’s current system is not only unfair but also unsustainable for the long-term health of the sport,” stated a representative for 23XI Racing in a press release. “We are committed to fighting for a more competitive and equitable surroundings for all teams.”
A hearing on the motion for summary judgement is scheduled for November 15,2024,before Judge Kenneth Bell. The outcome of this hearing could considerably influence the future of NASCAR’s parts procurement process and the financial viability of its teams.
